SePtember !2' 1978,~ <br /> <br /> "~ you~ill recall City Council was presented a petition by a number of residents <br /> of Stratford'Street and Liston Lane in Cavalier Manor concerning the lack of City maintenance <br /> on a drainage ditch which runs along the rear property line of the residences between the <br /> two streets. My, review of this matter with the Department of Public Works has concluded <br /> that this ditch is a private ditch which draing only private property. <br /> <br /> Section 55~9of the Code of the City of ~ortsmouth provides, that where there are easemen~ <br />across private property for surface drainage it is the obligation of the abutting property <br />owners to keep all drainage ditches open along said easements. Although there is no easement <br />involved in this case, the principle of abutting property owners being obligated to keep <br />a surface drainage ditch open would apply. <br /> <br /> The Eity's policy, past and present, has been to maintain drainage ditches only in <br />cases where street drainage or the drainage of other public property is involved. Since <br />the ditch in question drains only private property, the Department of Public Works has advised <br />residents residing along the ditch on numerous occasions that the ditch was not the responsibi] <br />of the ~it? t? maintain. In My opinion the City's policy is clear, and the Department of <br />Public ~or~s has acted correctly in refusing to maintain the ditch. <br /> <br /> Attached for your information is a planimetric showing the ditch in question? <br /> <br /> Motion of Mr. Oast and seconded by Mr. Barnes, the report to be received as information, <br />and was a~dpted by unanimous ~ote. <br /> <br /> The following reports from the City Manager were presented: <br /> <br /> 78-306 "Consideration of an ordinance on first reading to appropriate $28,000 from <br />the Capital Improvements Fund for the construction of an overhead electrical, pneumatic <br />supply and exhaust system for the City Garage. <br /> <br /> Thi~. appropriation will provide the necessary funds to meet improvements to the City <br />Garage Complex to provide an efficient exhaust system in accordance with OSHA safety standards <br />and regulations. Due to the repair type work, the running of the vehicles is a necessity; <br />and, in order to meet the OSHA guidelines from a safety standpoint an approved overhead <br />system is required. This project was included in the 1978-79 Capital Improvements Work <br />Program. The City Manager recommends adoption. <br /> <br /> Consideration of a motion to authorize award of bid to the lowest responsible bidder." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Barnes, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $28,000 FROM THE CAPITAL IMPROVEMENT FUND FOR THE <br />CONSTRUCTION OF OVERHEAD ELECTRIC, PNEUMATIC SUPPLY AND EXHAUST SYSTEM FOR THE <br />CITY GARAGE." <br /> <br /> Motion of Mr-.~Barnes~and~seconded by Mr. Gray to award contract to Hydraulic Servic% <br />being the lowest responsible bidder, and was adopted by unanimous vote. <br /> <br /> 78-507 "Consideration of an ordinance creating the Portsmouth Housing Development <br />Board; stating the purpose and powers of such Board. <br /> <br />Inc <br /> <br /> This ordinance is necessary to establish the basis of a S member Board to be appointed <br />by the City Council. The membership will consist of 4 persons from local savings and loan <br />associations, cammercial banks, and mortgage banks; and 1 at-large member who is a resident <br />of the City. This Board is necessary in order to meet the requirements of the State Code. <br />Additional information concerning the powers and duties of this Board is contained in a <br />lette~ f~om the._City Attorney which is attached for your information. The City Manager <br />recommends adoption. <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Oast, the following ordinance was adopted on <br />first-and fi~at readinM,~and by the following vote: <br /> <br /> "AN DRDINANCE CREATING THE PORTSMOUTH HOUSING DEVELOPMENT BOARD; STATING THE <br /> PURPOSE AND THE POWERS OF SUCH BOARD." <br /> <br />Ayes: Barnes, Gray, Holley, Oast <br />Nays: None <br /> <br /> 78-508 Mo~ion.~of M~;'Barnes and seconded by Mr. Oast that the agenda be <br />deleting Item 78-508 at this time to be brought back at the end of the meeting, <br />ed by unanimous vote. <br /> <br />amended by <br />and was adopt- <br /> <br /> 78-509 - "Consideration of a resolution endorsing the Clean Community Commission's <br />sponsorship of the Keep America Beautiful Workshop. <br /> <br /> This resolution endorses the efforts of the Clean Community Commission in sponsoring <br />the Keep America Beautiful Project Leadership Workshop for other cities in Portsmouth on <br />September 20 through 22, 1978. Resolution resolves that the City Council proudly welcomes <br />the Keep America Beautiful Workshop participants and wishes them a most pleasurable and <br />successful visit.
