82 <br /> <br />September 26~ 1978 <br /> <br />"AN ORDINANCE TO APPROPRIATE $71,700 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />MISCELLANEOUS CAPITAL PROJECTS." <br /> <br /> 78-321 - "COnsideration of an ordinance to amend the City Code pertaining to the Ports- <br />mouth Supplemental Retirement System. <br /> <br />The current City Code requires retirement of all City employees who are members of the ~ <br />Supplemental Retirement System at age 65. This requirement has been superceded by Federal la~ <br />due to an amendment to the Age Discrimination in Employment Act extending the age to 70. A / <br />letter explaining in detail the impact of the Act and the proposed amendments to the Code is ~ <br />attached for your information. The City Manager recommends adoption.'' ~ <br /> On motion of Mr; Barnes and seconded by Mr. Gray, the following ordinance was adopted on <br />first and final reading, and by the following vote: <br /> <br /> "AN ORDINANCE TO ~4END THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br /> ~,4ENDING SECTIONS 31-1, 31-30(b), 31-62(b), 31-68~a)(b) AND 31-118(b), PERTAINING <br /> TO THE PORTSMOUTH SUIPLEMENTAL RETIR~vlENT SYSTEM." <br /> <br />Ayes: Barnes, Early, Elliott, Gray, Davis <br />Nays: None <br /> <br /> 78-322 - "Consideration of an ordinance to amend the City Code pertaining to mandatory <br />termination of ~employmen% of those officers and employe~s not subject to the Retirement <br />System. <br /> <br /> This Section of the code applies to general administration and covers the mandatory ter- <br />mination of employment for all employees whether or not they are under a retirement system. <br />The proposed amendment will change the mandatory termination age from 65 to 70. Kay, ~xecutive Director, Portsmouth Redevelopment & Housing Authority, <br />presented a brief: s~mar~;~of the 1979-81 Community Development Program. <br /> <br /> The following letter was received from Mrs. Zelma Rivin, Chairperson, Portsmouth Plannin~ <br />Commission: I <br /> <br /> "On August 22, 1978, City Council was joined by members of the Portsmouth Redevelopment <br />and Housing Authority and the City Planning Commission in an advertised tripartite public <br />hearing at which was considered a document entitled <br /> <br />CITY OF PORTSMOUTH 1979-81 <br />CO~UNITY DEVELOPMENT PROGRA}4 <br /> <br />submitted to you on August 18, 1978 by City Manager R. T. Williams. The record of that publi~ <br />hearing was transcribed by a court reporter and has been circulated. The subject was covered <br />extensively both beforehand after the public hearing by public media. <br /> <br /> At its regualr monthly meeting on September 5,' 1978, the City Planning Commission re- <br />solved unanimously to endorse the document as submitted and considered at the public hearing. <br />O~ Commissioners ar,e acutely aware of the fact that there exist far more potential community[ <br />development needs;than funds with which to address them. It is heartening to see the increas~ <br />in citizen particip~tiO~ from a steadily growing number of neighborhoods organized to promote~ <br />local grassroots civic action. Our Commissioners prOfited from participation in this annual <br />endeavor and feel that the City Manager's approach represents the most effective and prudent <br />use of our slender res0urces." <br /> <br /> The followini ietter was received from Michael A.
