<br />At a regular meeting of the City Council held on January 9, 1979, there were present:

<br />E. Saunders Early, Jr. Archie Elliott, Jr., J. Robert Gray, James W. Holley,
<br />Edward L. Oast, Jr., Robert T. Williams, City Manager, Gordon B. Tavloe, Jr.,
<br />City Attorney.
<br />
<br />Absent: Richard J. Davis, Jack P. Barnes
<br />
<br /> Rev. James D. Smith, Rector, St. Christopher's Church, opened the meeting with prayer,
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br /> Vice Mayor Holley presided in the absence of Mayor Davis, and welcomed all visitors in
<br />attendance.

<br />1978; minutes of the called of December 12, 1978; minutes of the regular meeting

<br /> 78-427 The following ordinance approved on first reading at the Public Hearing of
<br />December 11, 1978, was taken up and read:
<br />
<br />(a) "ZONING AMENDMENT ORDINANCE Z 78620''
<br />
<br /> On motion of Mr. Early and seconded by Mr. Gray, the ordinance was adopted, and by the
<br />following vote:
<br />
<br />Ayes: Early, Elliot,, Gray, Holley, Oast
<br />Nays: None
<br />
<br /> 78-427 The following petition of Germar Realty, by Marvin Goldfarb, Owner, postponed
<br />from Public Hearing of December 11, 1978, was taken up and read:
<br />
<br />(C) "Z 78-22"
<br />
<br />The £ollowing letter from the Newtown Community Development Committee was presented:
<br />
<br /> "In reference to item Z-78-22 on Council's Agenda Petition of Mr. Marvin Goldfarb,
<br />the Newtown Community Development Committee acknowledges the courtesy of Council in postponin~
<br />action on said petition until it could be reviewed and commented upon by the Committee.
<br />
<br /> After meeting with Mr. Goldfarb and his attorney; as well as representatives 6f the
<br />Portsmouth Redevelopment and Housing Authority, the committee in concert with the afore-
<br />mentioned parties agrees that the petition of Mr. Goldfarb should be deferred back to the
<br />Planning Commission while appropriate consideration be given_tu~amending the Community's
<br />Land Use Plan. Such amendment would provide C-1 Zoning for the entire block in question
<br />between Fourth and Fifth Streets.
<br />
<br /> We further agree that to zone a portion of the block for a particular use as was being
<br />Froposed would serve only to disharmonize the ~lock and the plan as has been developed. Such
<br />fragmentation we believe would not be in the best interest of the development of the communit'
<br />
<br /> It should also be noted that amending the plan to permit £-1 zoning for the entire block
<br />might possibly attract ~much needed meighborhood convenience commerce. Signed by John G.

<br /> Joseph Breziotti, Jr., 4217 Quince Road, representing Newtown Community Development
<br />Committee, stated the Committee was in agreement with proposal to defer the application as
<br />presently submitted.

<br /> Raymond H. Strople, Attorney, representing the petitioner, requested the petition to be
<br />referred back to the Planning Commission.
<br />
<br /> Mot[on of Mr. Early and seconded by Mr. Gray, the petition to be referred back to the
<br />Planning Commission, and was adopted by unanimous Yore.
