<br /> WHEREAS, the owners of said property have agreed to convey additional property for the
<br />relocation of.said easement and to pay the cost of relocating the pipe therein in exchange
<br />for release of existing drainage easement.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the Council hereby expresses its consent to the vacation and release of the existing drainage
<br />easement as shown on that certain plat entitled, "Plat Showing Ten Foot Drainage Easement
<br />Across Lot 133, Plat of North Truxton, Portsmouth, Virginia" dated January 18, 1979, prepared
<br />by E. Stuart Ball and Associates, Ltd., a copy of which is attached to this resolution for
<br />more particular description of said easement.
<br />
<br /> BE IT FURTHER RESOLVED that the City Manager be, and hereby is, authorized to sign an
<br />easement agreement declaring the vacation and release of said easement and dedicating additional
<br />property for relocation of the existing drainage line."

<br /> 79-47 - "Consideration of a motion to transfer $5,000 from the Grants Contingency AccoUnt
<br />to improve the electrical system of the Colony Theater.
<br />
<br /> This motion will provide the necessary funds in order to prepare plans to bring the
<br />building electrically up to Code and permit its eventual use for programs sponsored by the
<br />Community Arts Center. The entire amount is provided through a grant from the Virginia Com-
<br />mission of the Arts and Humanities under its Challenge Grant.Program. The City Manager
<br />recommends adoption."

<br /> Motion of Mr. Barnes and seconded by Mr. Gray, that authorization be granted to transfer
<br />$$,000 from the Grants Contingency Account, as requested, and was adopted by unanimous vote.
<br />
<br /> 79-48 - "Consideration of a resolution appointing viewers for the closing of a portion
<br />of Cherokee Road extended.
<br />
<br /> The Trustees of Olive Branch Baptist Church have made application to va'cate and close
<br />this section of Cherokee Road. This resolution appoints viewers for a report back to City
<br />Council in accordance with State law. The City Manager recommends adoption."

<br /> On motion of Mr. Holley and seconded by Mr. Early, the following resolution was adopted,
<br />and by the following vote:
<br />
<br />"A RESOLUT~ION APPOINTING VIEWERS FOR CLOSING THE FOLLOWING: ALL THAT PORTION
<br />OF CHEROKEE ROAD EXTENDED.
<br />
<br /> WHEREAS, the Trustees of Olive Branch Baptist Church have made application to vacate,
<br />close and discontinue the hereinafter-described portion of Cherokee Road Extended, and it
<br />appearing that Notice of Application for the appointment of viewers was duly posted January
<br />19, 1979 on the bulletin board of the Geheral District Court, Civil Division, of the City
<br />of Portsmouth, the bulletin board of the Circuit Court of the City of Portsmouth, and the
<br />bulletin board of City Hall of the City of Portsmouth.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />Frank N. Bilisoly, Linon Vann, James Linehan, Richard Ottavio and James McGehee, be appointed
<br />viewers and Robert Reed be appointed an alternate viewer in the event one of the preceding
<br />viewers fail to participate, said viewers to view the hereinafter-described portion of such
<br />road and to report to this Council in writing whether in their opinion any, and if any, what
<br />inconvenience would result in vacating and closing the following:

<br />CHEROKEE ROAD
<br />
<br /> All that portion of Cherokee Road Extended at the property line of
<br />Isadore Wallace, which said point is approximately 200 feet east of the
<br />point where Cherokee Road reduces in size from a 50 foot right-of-way,
<br />and from said point; thence continuing ina south-easterly direction 432.44
<br />feet to the line of the property of W. L. Holland, which said south-eastern
<br />point is approximately 175 feet from the north side of Airline Boulevard."

<br /> George A. and Martha L. Hunt have made application to vacate and close a.portion of
<br />Fairfax Avenue. This resolution appoints viewers for a report back to City Council in accord~
<br />once with State law. The City Manager recommends adoption."

<br /> On motion of Mr. Barnes and seconded by Mr. Oast, the following resolution was adopted,
