<br />lots 1 through 4, Block H, in Prentis Park; for the purpose of constructing a playground
<br />in the Prentis Park neighborhood. The owners have refused the offer; therefore, this
<br />resolution authorizes condemnation for th~ purpose of proceeding with the project. The
<br />City Manager recommends adoption.

<br /> On motion of Mr. Elliott and seconded by Mr. Oast, the following resolution was adopted,
<br />and by the following vote:

<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br />OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER
<br />471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br />THE CONSTRUCTION OF THE PRENTIS PARK PLAYGROUND.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinaft~
<br />specified inand to the hereinafter described parcel of land situate in the City of Portsmout]
<br />Virginia, for. t~e construction of the Prentis Park Playground; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described
<br />herein necessary to the pro3ect, because the owners thereof and the City have not been
<br />able to agree upon the consideration to be paid therefor; and
<br />
<br /> WHEREAS, advancement of the work and use of said project will be unreasonably delayed
<br />if said property is non made available as soon as possible.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the City Attorney be, and he hereby is, directed to institute eminient domain proceeding
<br />against the following property situate in the City of Portsmouth, Virginia, for the purpose
<br />of acquiring fee simple title therein, together with any and all easements of access,
<br />light or air incident to. the lands of the landowner abutting upon said property in accordance
<br />with, and pursuant to Section 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth
<br />(Chapter 471 of the Acts of Assmebly 1970, as amended), and to deposit to the credit of
<br />the Clerk of the Circuit Court of the City of Portsmouth, as provided by law, the sum
<br />hereinafter specified to compensate the owners of the parcel of land known, numbered and
<br />designated as Lots 1, 2, '3 and 4, Block H on the plat entitled, "Addition To Prentis
<br />Place", recorded in the Circuit Court of the City of Portsmouth, Virginia in Map Book 4,
<br />Page 45. '

<br />portion of an unnamed lane in north Truxtun.

<br /> Construction Associates has made application to vacate and close a portion of an
<br />unnamed alley in north Truxtun. The Planning Commission has recommended same. Pursuant
<br />to State law, this resolution will appoint viewers for a.report back to City Council. The
<br />City Manager recommends adoption.
