Johnson, Owner, 801 Loudoun Avenue, spoke and requested that <br />as it had been approved by the Planning Commission. <br /> <br /> Motion of Mr. Holley and seconded by Mr. Gray, <br />Planning Commission. <br /> <br /> Motion af Mr. Hotley end seconded by Mr~-Elliatt, <br />to address Council again. <br /> <br /> Mr. Johnson spoke concerning the number of buildings already <br />to consider the shopping center as whole for zoning. <br /> <br />23, 1979, was <br /> <br /> C-2 be approved <br />to concur with the recommendation of the <br /> <br /> to.suspend the r~te; for Mr. Johnson <br /> <br /> in the shopping center and <br /> <br /> The following ozdinance ~as approved~on first reading, and was adopted-oy 6- (Nay-Oast) <br />vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 79-9" <br /> <br /> 79-135 <br />approved on first <br />following vote: <br /> <br />On motion of Mr. Holley and seconded by Mr. Barnes, the following resolution <br /> reading at the Public Hearing of April 23, 1979, was adopted and by the <br /> <br /> ' G <br />"A RESOLUTION GRANTIN A USE PERMIT TO MARIE WILSON HARRIS TO OPERATE A DAY <br />CARE CENTER PURSUANT TO SECTION 40-78(b). <br /> <br /> WHEREAS, Marie Wilson Harris, made an <br />Code of the City of Portsmouth, Virginia, <br />described; and <br /> <br /> application pursuant to Section 40-78(b) of the <br />1973, for the granting of a use permit as hereinafte <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />the neighborhood of the proposed use; <br /> <br /> the property or <br /> <br /> (b) Will not be detrimental to the public use or injurious ~o <br />improvements in the neighborhood; and <br /> <br /> (c) Will be ~n accord with the purposes of the Zoning Chapter of the City Code. <br /> 2. Marie Wilson Harrms is hereby granted a use permit pursuant to Section 40-78(b) <br />of the City Code to operate a day care center at the property described as £cllows: <br /> <br /> <br />
