This use permit is approved subject to the following conditions: <br /> <br /> (a) That there not be more than ten ~IC) children under six (6) years <br />of age enrolled at an) one time in the facility as it exists today; <br /> <br /> That the owner must provide five (5) off-street parking spaces improved <br />to the ~i~b'~f Portsmouth's specifications prior to being given a certificate of occupancy." <br /> <br />Ayes: Barnes, Early, Elliott, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-135 On motion of Mr. Gray and seconded by Mr. Elliott, the following resolution <br />approved on first reading at the Public Hearing of April 23, 1979, was adopted and by the <br />following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH REDEVELOPMENT AND <br />HOUSING AUTHORITY TO OPERATE A DAY CARE CENTER FACILITY PURSUANT TO S£CTION <br />40-78(b) OF THE CITY CODE. <br /> <br /> WHEREAS, Portsmoutk Redevelopment and Housing Authority, <br />to Section 40-78(b) of the City Code of Portsmouth, Virginia, <br />use pein.it a~ hereinafter-described; and <br /> <br />made an application, pursuant <br />1973, for the granting of a <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection.with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter is sought: <br /> <br /> ~) Will not adversely Jffect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or im- <br />provements in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Portsmouth Redevelopment and Housing Authority is <br />to Section 40-78(b) of the'City Code to operate a day care <br />described as follows: <br /> <br />hereby granted a use permit pursuan' <br />center facility at the property <br /> <br /> In the Community Center at the Ida Barbour Public Housing Park, <br />said Center ms on the east side of Barbour Drive, approximately 245 <br />feet north from its intersection of South Street, having an address <br />of 1104 _Barbour Drive. <br /> <br />3. This use permit is approved subject to the following conditions: <br /> <br />(a) The Facility will be operated ~from 8:30 A.M. to 3:00 P.M. <br /> <br /> (b) The facility will begin operation with twenty-six children under six (6) years <br />of age; and this may rise to forty (40) children. <br /> <br />STOP organization will run the operation. <br /> <br />(d) The STOP organization will use their van to pick up and deliver the children. <br /> <br /> [~) Chit~dren will come. fromtthe surrounding community and five other PRHA housing <br />projects. <br /> <br /> (f) Fire Department inspection shows need <br />fire extinguishers. <br /> (g) The Health Department inspection shows <br /> <br />for a lock on the back door and three <br />a need for drainage improvement." <br /> <br />Ayes: Barn'es, Ear]y, Elliott, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-135 - The foliowing ordinance approved on first reading at the P~blic Hearing of <br />April 23, 1979, was taken up and read: <br /> <br />"AN ORDINANCE TO AMEND SECTION 40-193(a) OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, PERTAINING TO APPROVAL OF~PLANS FOR CONSTRUCTION IN THE COMMERCIAL <br />C-3 DISTRICT." <br /> <br /> <br />
