<br />"A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO INSTITUTE APPROPRIATE LEGAL
<br />PROCEEDINGS TO ENEORCE THE PROVISIONS OF THE OLDE TOWNE CONSERVATION PROJECT
<br />(VA.R-49) PERTAINING TO UNDERGROUND UTILITIES.
<br />
<br /> WHEREAS, the conservation plan for Olde Towne Conservation Project (VA.R-49) as amended
<br />February, 1976, provides that all utilities within the project area.shall be placed under-
<br />ground and all service connections to users of such utilities shall be underground; and
<br />
<br /> WHEREAS, the City has expended $360,000 to provide easements and to locate underground
<br />electric, gas and telephone service within the conservation district; and
<br />
<br /> WHEREAS, some 27 structures within the conservation district have failed to change over
<br />to underground service thereby requiring the maintenance of dual overhead and underground
<br />utility systems; and
<br />
<br /> WHEREAS, the Olde Towne District has been designated as a historic area by the Virginia
<br />Historic Landmarks Commission and Portsmouth City Council; and
<br />
<br /> WHEREAS, the historic characteristics of the Olde Towne Dis'trict will be better preserved
<br />by a uniform system of underground utilities.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Attorney be, and he hereby is, authorized to institute appropriate legal proceedings
<br />to enforce the provisions of the Olde Towne Consezvation Project (VA.R-49) as amended February
<br />19Z6, pertaining to underground facilities."

<br /> 79,t72 "Consideration of a resolution authorizing the~City Manager to convey property
<br />to the Portsmouth Redevelopment and Housing Authority in the Southside EDA Project area.
<br />
<br /> The City has closed portions of Scott, Griffin, Race and Wythe Streets and retained
<br />easements within the closed right-of-way. In addition, the Cit) owns a certain parcel of
<br />property which was the former Court Street and 4th Street intersection. This resolution
<br />will authorize the City Manager to convey to the Portsmouth Industrial Development
<br />Authority the easements and parcel of property for the purposes of consolidating the interests
<br />for industrial development. The City Manager recommends adoption.'

<br /> On motion of Mr. Barnes and seconded by Mr. Oast, the following resolution was adopted,
<br />and by the following vote:

<br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY PROPERTY TO INDUSTRIAL
<br />DEVELOPMENT AUTHORITY OF THE CITY OF PORTSMOUTH (COURT STREET AND WYTHE STREET)-.
<br />
<br /> WHEREAS, the City of Portsmouth owns certain easements and rights-of-way as a result of
<br />the closure of portions of Scott Street, Griffin Street, Race Street and Wythe Street by
<br />ordinances adopted on September 11, 1973, and August 23, 1977; and
<br />
<br /> WHEREAS,

<br />Portsmouth Redevelopment and Housing Authority is conveying the property on whi(
<br />are located and arrangements have been made to relocate the utilities within
<br />and

<br /> WHEREAS, the City owns a certain parcel~of property on which the former Court Street and
<br />Fourth Street intersection was located; and
<br />
<br /> WHEREAS, Section 2.09(c) of the Charter of the City of Portsmouth provides that the
<br />may convey property to the Commonwealth of Virginia or any political subdivision thereof,
<br />without advertisement and without receiving bids; and

<br /> WHBRBAS, thc Industrial Development Authomity of the City of Portsmouth is a political su
<br />division of the Commonwealth of Virginia.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager be, and he hereby is, authorized to convey the following described property
<br />to Industrial Development Authority of the City of Portsmouth:
<br />
<br /> PARCEL 1. Any and ali right, title, interest, easement
<br />or right-of-way in and to the following described property,
<br />to-wit:
<br />
<br /> SCOTT STREET. All that certain piece or parcel of land,
<br />lying and being in the City of Portsmouth, Virginia, comprising
<br />that portion of Scott Street between Washington Street and Fifth
<br />Street.
<br />
<br /> GRIFFIN STREET. All that certain ~iece or parcel of land, lying
<br />and being in the City of Portsmouth, Virginia, comprising that
<br />portion of Griffin Street between Washington Street and Fifth Street.
<br />
<br /> RACE STREET. All that certain piece or parcel of land, lying
<br />and being in the City of Portsmouth, Virginia, comprising that
<br />portion of Race Street between Washington Street and Fifth Street.
