<br /> 79-241 "Consideration of a resolution authorizing the City Manager to release any
<br />and all rights, title and interest in a portion of Peachtree Lane.

<br /> The subdivision plat of Peachtree~ PUD, Section I dedicated to the City a portion of
<br />Peachtree Lane as a cul-de-sac. This cul-de-sac was to be abandoned when Peacht?~ez~A~ne
<br />was extended. This resolution will authorize the City Manager to release the City's claim
<br />to that portion of Peachtree Lane designated as the cul-de-sac for the purpose of extending
<br />Peachtree Lane. The City Manager recommends adoption." ~o~l

<br /> On motion of Mr. HOlley and seconded by Mr. Barnes, the following resolution was adopted,
<br />and by the following vote:

<br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY~ CITY-OWNED PROPERTY
<br />(PEACHTREE LANE).
<br />
<br /> WHEREAS, by Subdivision Plat of Peachtree PUD, Section 1, recorded in the Clerk's Office
<br />of the Circuit Court of the City of Portsmouth, Virginia, in Map Book 10, Page 10, the develop
<br />ers thereof, Peachtree Associates, provided for dedication of two (2) pieces of land on either
<br />side of Peaahtree Lane at its northern extremity for the creation of a cul-de-sac for said dea
<br />end street pursuant to the requirements of the Subdivision Code of the City of Portsmouth; and
<br />
<br /> WHEREAS, the aforesaid Subdivision
<br />be abandoned if and when Peachtree Lane
<br />and
<br />
<br />Plat additionally provided that said cul-de-sac was to
<br />was extended beyond this point in a northerly directioh;
<br />
<br /> WHEREAS, by Subdivision Plat of Peachtree PUD, Section S, recorded in the aforesaid
<br />Clerk's Offi'ce in Map Book 10, Page 82, Peachtree Lane was extended beyond its original ter-
<br />minus in a northerly direction, having a right-of-way of sixty feet (60').
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager be, and he hereby is, authorized to release any and ali right, title and
<br />interest which the City of Portsmouth may have acquired in the temporary cul-de-sac portions
<br />lying outside the present sixty foot (60') right-of-way of Peachtree Lane as dedicated in the
<br />Plat of Subdivision of Peachtree PUD, Section S, recorded in Map Book 10, Page 82.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute
<br />such documents as may be deemed necessary to complete this transaction."

<br /> 79-242 "COnsideration of a motion authorizing the City Manager to transfe~ $260,000 from
<br />the Emergency Contingency Account in the General Fund to the Debt Service Fund.
<br />
<br /> The Debt Service Fund requires $260,000 in order to meet principal and interest on bonds
<br />fo~the balance of the 1978-79 Fiscal Year. The short-fall is due to over estimating the
<br />amount of revenue in the Debt Service Fund to be received from Utility Taxes. The City amende,
<br />the Code with the adoption of the 1978-79 Budget increasing the Utility Tax in certain cate-
<br />gories. However, due to the mechaniss involved with the utility companies, the City did not
<br />collect the increased taxes for the first month of the Fiscal Year. Based on this there has
<br />been a short-fall in revenue and it is being transferred from the Emergency Contingency Accoun'
<br />for this purpose, The City Manager recommends adoption."
<br />
<br /> Motion of Mr. Barnes and seconded by Mr. Holley, that authorization be granted to transfe~
<br />$260,000 from the Emergency Contingency Account, as requested, and was adopted by unanimous
<br />vote.
<br />
<br /> 79-243 - Motion of Mr. Barnes and seconded by Mr. Holley, that authorization be granted
<br />to execute contract between the City and Garden Club of Virginia for landscaping of Courtyard
<br />at 1846 Court House, was adopted by unanimous vote; the following resolution was adopted,
<br />and by the following ~ote:

<br />"A RESOLUTION EXPRESSING THE GRATITUDE OF THE CITY TO THE
<br />VIRGINIA FOR UNDERTAKING THE LANDSCAPING OF THE COURTYARD
<br />THE 1846 PORTSMOUTH .COURT-HOUSE.

<br />APPURTENANT TO
<br />
<br /> WHEREAS, The Garden Club of Virginia has agreed to arrange for and pay the cost of landscRping
<br />of the cour-tyard appurtenant to the 1846 Portsmouth Courthouse; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth wishes to express its gratitude to The
<br />Garden Club of Virginia for such generosity.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the gratitude of the citizens of the City of Portsmouth and the Council of the City of Ports-
<br />mouth, is hereby publicly expressed to rhe Garden Club of Virginia in appreciation for
