<br /> 79-276 - "Consideration of an ordinance to amend the City Code pertaining to bingo games
<br />and raffles.
<br />
<br /> This ordinance will amend the City Code to comply with legislation amending the State Cod
<br />as a result of actions of the 1979 General Assembly. The only major change provides for an
<br />application fee, in the amount of $2S, for persons to operate bingo games. Such funds will
<br />help pay for the administrative costs involved in issuing the permit. In addition, the ordi- I
<br />nance amends the audit fee for the annual financial report prescribed by State law, allowing aF
<br />audit fee of 1% of the gross receipts from the bingo games. The City Manager recommends adop-
<br />tion.''

<br /> On motion of Mr. Early and seconded by Mr. Oast, the following ordinance was adopted on
<br />first and final reading, and by the following vote:

<br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, BY AMENDING
<br />SECTION 21-54 THEREOF, PERTAINING TO BINGO GAMES~AND RAFFLES."

<br /> 79-277 "Consideration of an ordinance closing a portion of a 15' alley on the southside
<br />of Commerce Street.
<br />
<br /> Citizens Trust Bank, et al, have made application to vacate and close a portion of a 15'
<br />alley on. the southside of Commerce Street. City Council adopted a resolution appointing view-
<br />ers on June 6, 1979, pursuant to State law. Attached is a copy of the viewers report along
<br />with a map out lining the portion of the alley to be Closed. The closing has been reviewed
<br />by the City's Economic Development staff and the Portsmouth Port and Industrial Commission.
<br />Based on their investigation the closing of the 15' alley will pose no inconvenience to pro-
<br />perty owned by PPIC. The City Manager recommends adoption."

<br /> John R. Porter, III, Attorney, 520 Citizens Trust Building, representing Citizens Trust
<br />Bank, Trustee, et als, requested that the ordinance be effective on date of the adoption.

<br /> On motion of Mr. Early and seconded by Mr. Gray, the following ordinance was adopted on
<br />first and final reading, and by the following vote:

<br /> 79=278 "Consideration of an ordinance to amend the City Code by repealing two sections
<br />thereof pertaining to the Museum and Fine Arts Commission.
<br />
<br /> This crdinance will amend the City Code by repealing two sections which place the opera-
<br />tion and management responsibility for museums and other cultural facilities in the Museum
<br />and Fine Arts Commission. By repealing the two sections of the City Code there remains
<br />Section 2F296 of the City Code which prescribes that the Museum and Fine Arts Commission
<br />will act as an advisor to the City Council on all matters pertaining to the museums and other
<br />cultural facilities. The Museum and Fine Arts Commission will th~n he similar to most other
<br />City commissions, that being in an advisory capacity. The City Manager recommends adoption."

<br /> On motion of Mr. Holley and seconded by Mr. Oast, the following ordinance was adopted on
<br />first and final reading, and by the following vote:

<br /> %9-279 "Consideration of a resolution authorizing the City Manager to commit annually
<br />to the Portsmouth Port and Industrial Commission (PPIC) the receipts derived from the Unifi-
<br />cation Contract between PPIC, the City of Portsmouth, and the Virginia Port Authority.
<br />
<br /> This resolution will authorize the City Manager to commit, annually, receipts derived
<br />from the. revenues of the Portsmouth Marine Terminal, Inc. The Unification Contract prescribed
<br />a certain percentage to be received annually, which is projected to be approximately S50.000
<br />for the next eleven (11) years. The commitment of these funds will permit PPIC to secure
<br />financing for necessary options or purchases. By committing these funds the City Council
<br />expresses its support for the continued industrial development activities of PPIC. This
<br />resolution also requires repayment of any such funds paid to PPIC if any such property is
<br />disposed of to private owners or occupants. The City Manager recommends adoption."

<br /> On motion of Mr. Barnes and seconded by Mr. Gray, the following resolution was adopted,
<br />and by the following vote:

<br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO CON, IT ANNUALLY FOR ELEVEN YEARS
<br />BEGINNING SEPTEMBER, 1979, TO THE PORTSMOUTH PORT AND INDUSTRIAL COMMISSION
<br />THE RECEIPTS OF THE UNIFICATION CONTRACT OF THE PORTSMOUTH PORT AND INDUSTRIAL
<br />COMMISSION, CITY OF PORTSMOUTH AND VIRGINIA PORT AUTHORITY; REPAYMENT OF FUND.
<br />
<br /> WHEREAS, pursuant to a Unification Contract dated April 1, 1971, as amended, between the
<br />Portsmouth Port And Industrial Commission, City of Portsmouth and Virginia Port Authority, the
<br />City receives a certain percentage of annual proceeds from the operation of Portsmouth Marine
