WHEREAS, no lots created by this subdivision plat have been sold therein; and <br /> <br /> WHEREAS, the owners of said property have expressed the intention of abandoning the propo <br />subdivision and desire to vacate the plat; and <br /> <br /> WHEREAS, Section 15.1481, Code of Virginia, 1950, as amended, provides that any such <br />may,be vacated with the consent of the governing body and the owners or prcprietors at any <br />before the sale of any lot therein by written instrument to be recorded in the same Clerk's <br />Off~ce wherein plat is recorded. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the consent of the Council to the vacation of said plat is hereby expressed. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to sign suc <br />instruments and documents as may be necessary to complete this transaction." <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br />The following reports from the City Manager were presented: <br /> <br /> 79-273 "Consideration of an ordinance on first reading to appropriate $500,000 from the <br />Capital Improvements Fund for the purchase and lease of multipurpose capital equipment. <br /> <br /> This appropriation will provide the necessary funds to purchase approximately $260,000 <br />of equipment and to make lease payments of approximately $240,000. A list ms attached which <br />itemizes the equipment involved. This project ms included in the current Capital Improvements <br />Program. The City Manager recommends adoption on first reading. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Barnes, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPRCPRIATE $500,000 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />THE PURCHASE AND LEASE OF MULTI-PURPOSE CAPITAL EQUIPMENT." <br /> <br /> 79-274 "Consideration of an ordinance on first reading to appropriate $18,600 from <br />the Capital Improvements Fund for the extension of the History Room at the main library. <br /> <br /> This appropriation will provide the necessary funds to construct a History Room at the <br />main library and to provide the necessary book shelves and furnishings. The source of fund- <br />ing for this appropriation is General Revenue Sharing funds included in the contingency of <br />the 1979-80 Capital Improvements Program. The History Room will provide additional space <br />needed-~for~th~ proper care and display of the library's valuable books. This project was <br />discussed with City Council previously at the Public Hearing on the Capital Improvements <br />Plan. The City Manager recommends adoption on first reading. <br /> <br />Consideration of a motion to award bid to the lowest responsible bidder." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Early, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $18,600 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />THE EXTENSION OF THE MAIN LIBRARY HISTORY ROOM." <br /> <br /> Motion of Mr. Early and seconded by Mr. Oast, the contract to be awarded to Rorrer <br />Construction Company, being the Lowest responsible bidder, in the amount of $13,161, and was <br />adopted by unanimous vote. <br /> <br /> 79-275 "Consideration of an ordinance to amend the City Code to prohibit the dumping <br />of trash, refuse, garbage, debris or any other unsightly material in the City of Portsmouth. <br /> <br /> This ordinance will amend the City Code by paralleling the State Code making it a mis- <br />demeanor v-iolation for the dumping of trash, garbage, refuse, debris, or other unsightly <br />material on property without the consent of the owner or his agent within the City of <br />Portsmouth. This ordinance will provide the necessary authorization and punishment to deter <br />the unlawful depositing of trash on public highways, private property and other areas. The <br />punishment for such violation is a Class I misdemeanor, with a fine of up to S1,000 and/or 12 <br />months in jail. This ordinance provides, however, that such punishment may be suspended upon <br />the person convicted agreeing to clean the area. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Barnes and 'seconded by Mr. Gray, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE <br />AMENDED, BY ADDING SECTION <br />REFUSE, GARBAGE, DEBRIS OR <br /> <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS <br />39-17, PERTAINING TO THE PROHIBITION OF DUMPT~G TRASH, <br />OTHER UNSIGHTLY MATTER IN THE CITY OF PORTSMOUTH." <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> <br />
