September 14, 1999 <br /> <br />99 - 205 - Adoption of a resolution for the Virginia Department of Transportation <br />(VDOT) approving the design of the Bart Street project which is required to purchase <br />the required right-of-way. <br /> <br />VDOT's six-year plan includes improvements to Bart Street as requested by the <br />City. The requirement for a public hearing has been met and permission is now <br />needed for the design of this project so that VDOT may proceed with right-of-way <br />purchase and subsequent construction. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution approving the design of the Bart Street project which is <br />required by the Virginia Department of Transportation (VDOT) to purchase the required <br />right-of-way. <br /> <br />Purpose and Need: <br /> <br />· The Virginia Department of Transportation's Six-Year Plan includes improvements <br />to Bart Street as requested by the City. <br /> <br />· The VDOT requirement for a public hearing has been met. This resolution <br />approving the design of the project is needed so that VDOT may proceed with right-of- <br />way purchase and subsequent construction. <br /> <br />· There were no comments as a result of the public notice. <br /> <br />Financial Impact: <br /> <br />· The most recent estimate of the project is approximately $3 million and the City's <br />share is 2% of the total cost. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Robinett, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION APPROVING THE MAJOR DESIGN FEATURES OF THE <br />PROPOSED BART STREET IMPROVEMENTS. <br /> <br /> WHEREAS, a "Notice of Willingness to Hold a Public Hearing was posted for the <br />purpose of considering the design features for Project No. 0017-124-108, PE-101 for a <br />portion of Bart Street in the City of Portsmouth; and <br /> <br /> WHEREAS, no requests were received or inquiries were satisfactorily answered, <br />so that a public hearing is not required; and <br /> <br /> WHEREAS, the City Council has previously requested the Virginia Department of <br />Transportation ("the Department") to program this project. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby approves the major design features of the proposed project as <br />presently designed. <br /> <br /> BE IT FURTHER RESOLVED that the City of Portsmouth will acquire all rights of <br />way necessary for this project and certify same to the Department at the appropriate <br />time. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby authorized to <br />execute, on behalf of the City of Portsmouth, all railroad and utility agreements required <br />in conjunction with the acquisition of such rights of way." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />99 - 206 - Adoption of a motion to transfer $197,000 from the Grants Contingency <br />Account for the Virginia Weed and Seed Initiative program. <br /> <br /> <br />
