September 14, 1999 99 - 205 - Adoption of a resolution for the Virginia Department of Transportation (VDOT) approving the design of the Bart Street project which is required to purchase the required right-of-way. VDOT's six-year plan includes improvements to Bart Street as requested by the City. The requirement for a public hearing has been met and permission is now needed for the design of this project so that VDOT may proceed with right-of-way purchase and subsequent construction. Recommendation: · Adoption of a resolution approving the design of the Bart Street project which is required by the Virginia Department of Transportation (VDOT) to purchase the required right-of-way. Purpose and Need: · The Virginia Department of Transportation's Six-Year Plan includes improvements to Bart Street as requested by the City. · The VDOT requirement for a public hearing has been met. This resolution approving the design of the project is needed so that VDOT may proceed with right-of- way purchase and subsequent construction. · There were no comments as a result of the public notice. Financial Impact: · The most recent estimate of the project is approximately $3 million and the City's share is 2% of the total cost. Motion by Mr. Benn, and seconded by Mr. Robinett, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION APPROVING THE MAJOR DESIGN FEATURES OF THE PROPOSED BART STREET IMPROVEMENTS. WHEREAS, a "Notice of Willingness to Hold a Public Hearing was posted for the purpose of considering the design features for Project No. 0017-124-108, PE-101 for a portion of Bart Street in the City of Portsmouth; and WHEREAS, no requests were received or inquiries were satisfactorily answered, so that a public hearing is not required; and WHEREAS, the City Council has previously requested the Virginia Department of Transportation ("the Department") to program this project. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that it hereby approves the major design features of the proposed project as presently designed. BE IT FURTHER RESOLVED that the City of Portsmouth will acquire all rights of way necessary for this project and certify same to the Department at the appropriate time. BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute, on behalf of the City of Portsmouth, all railroad and utility agreements required in conjunction with the acquisition of such rights of way."
