October 23, 1979 <br /> <br /> 79-392 "Consideration of a resolution appointing viewers for closing a portion of <br />the following streets: a 15' alley on the south side of Commerce Street; a 15' alley between <br />Commerce Street and Meander ~oad; a portion of Maryland Avenue, and a portion of Shea Court. <br /> <br /> The Portsmouth Port and'Industrial Commission has made application to close a portion <br />of Commerce,~Meander, Maryland, and Shea Court. This resolution will apoint viewers in <br />accordance with State law. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Oast and seconded by Mr. Gray, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING THE FOLLOWING STREETS: <br />ALLEY ON THE SOUTH SIDE OF COMMERCE STREET; A 15 FOOT ALLEY BETWEEN <br />STREET AND MEANDER ROAD; A PORTION OF MARYLAND AVENUE; A PORTION OF <br /> <br />A 15 FOO~ <br />COMMERCE <br />SHEA COURT. <br /> <br /> WHEREAS, Portsmouth Port and Industrial Commission has made application to vacate, <br />close and discontinue the hereinafter-described portions of certain streets, and it appearing <br />that Notice of Application and the request for the appointment of viewers was duly posted <br />on October 9, 1979, on the bulletin board of the Circuit Court, General District Court (Civil <br />Division), and Juvenile And Domestic Court for the City of Portsmouth, Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Frank N. Bilisoly, James V. McGhee, Raymond Tweed, C. E. Ellis and Linon Vann be appoint- <br />ed viewers and that A.-N. Kendrick be appointed an alternate viewer in the event one of the <br />preceding viewers fails to participate, said viewers to view the hereinafter-described portion <br />of such streets and to report to this Council in writing whether in their opinion, any, and if <br />any, what inconveniences would result in vacating and closing the following: <br /> <br />PARCEL <br /> <br />That certain i5 foot alley which is described as follows: <br /> <br /> .... BEGINNING on the south right of way line of Commerce Street 140 feet west <br />of its intersection with Chautauqua Avenue; thence running south 662 feet, more <br />or less, to a point; thence running southwesterly 15 feet, more or less, to a <br />point; thence running northerly 665 feet, more or less, to a point on the southern <br />right of way line of Commerce Street; thence running eastwardly along the said right <br />of way line 15 feet, more or less, to the said point of begins'int. Also,'that portion <br />of a said alley which is described as beginning on the northern right of way line of <br />Commerce Street 140 feet west of its intersection with S Avenue; thence running north- <br />erly 254 feet, more or less, to the termination of said alley; thence running west <br />15 feet, more or less, to a point; thence running south 254.5 feet to a point on the <br />northern right of way line of Commerce Street; and thence running east along the said <br /> right of way line 1S feet to the said point of beginning. <br /> <br />PARCEL II <br /> <br />That certain 15 foot alley being more particularly described as follows: <br /> <br /> BEGINNING on the southern right of way line of Commerce Street 140 feet east <br />of its intersection with Broad Street; thence running south to the northern right <br />of way line of Meander Road; thence running southeastwardly 15 feet along said <br />right of way of Meander Road to a point; thence north to the southern right of way <br />of Commerce Street; thence west along the said right of way 15 feet to the said <br />point of origin. <br /> <br />PARCEL III <br /> <br />A portion of Maryland Avenue being more particularly described as follows: <br /> <br />a. That portion of Maryland Avenue lying between the northern right of way line of <br />Meander Road and the southern right of way line of Commerce Street. <br /> <br />b. That portion of Maryland Avenue which, is described as beginning at the north- <br />eastern corner of Maryland Avenue and Commerce Street; thence running north along <br />the eastern right of way line of Maryland Avenue 257.4 feet, more or less, to the <br />termination of said Maryland Avenue; thence running west 70 feet, more or less, to <br />a point on the western right of way line of Maryland Avenue; thence running south <br />along the said right of way line 259 feet, more or less, to a point on the northern <br />right of way line of Commerce Street; thence running east along the northern right <br />of way line of Commerce Street 70 feet, more or less, to the said point of <br />beginning. <br /> <br />c. That portion of Maryland Avenue lying between the northern right of way line <br />of Seaboard Coast Lfne Railroad Company and Southern Railroad property and the <br />southern right of way line of Woodrow Street. <br /> <br />PARCEL IV <br /> <br />That portion of Shea Court which is more partic~larly described as follows: <br /> <br /> BEGINNING at a point on the northern right of way line of Commerce Street <br />140 feet east from its intersection with Chautauqua Avenue; thence running north <br />242 feet, more or less, to a point; thence running east 15 feet, more or less, <br />to a point on the northern right of way line of Commerce Street; thence running <br /> <br /> <br />
