309 <br /> <br />October 23, 1979 <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the amendment to said <br />use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That th~ use for which the use permit hereinafter is sought: <br /> <br /> ~a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of t~e proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or im- <br />provements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Angell Group, Inc. is hereby granted a use permit pursuant to Section 40-75(b) of <br />the City Code to operate a nursing home at the property described as follows: <br /> <br /> Beginning at the northeast intersection of Winchester Drive and Rodman <br />Ave'hue; thence north along the east side of Rodman Avenue to the south <br />right-of-way of Arlington Place; thence east along said right-of-way 90'; <br />thence south 108.5'; thence east 180'; thence north 108.5' to the south <br />right of-way of Arlington Place; thence east along said right-of-way to <br />the west right-of-way of Halifax Avenue; thence south along said right-of-way <br />to the north right-of-way of Winchester Drive; thence west along said right- <br />of-way to Rodman Avenue, the point of origin. Also known as 3610 Winchester <br />Drive. <br /> <br /> 3.
