<br /> WHEREAS, by the petitions submitted in accordance with Section 15.1240, Code of Virginza,
<br />certain abutting landowners have petitioned the City of Portsmouth to construct a sidewalk
<br />in Manley Street abutting 80, 82, 84, 86, 88, 90, 92, 94 and 96 o~ the south side of Manley
<br />Street and 81, 83, 85, 87, 89, and 91 on the north side of Manley Street and 2739 on the
<br />south side of Portsmouth Boulevard, where standard sidewalks do not exist; and
<br />
<br /> WHEREAS, notice has' been duly given to the
<br />15.1240, Code of Virginia, that a hearing would

<br /> WHEREAS, said hearing has been duly held and in judgment of Council the said sidewalk
<br />should be constructed.

<br />'NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> i. That the construction of a sidewalk in the street abutting 80, 82, 86, 88, 90, 92,
<br />94 and 96 on the south side of Manley Street and 81, 83, 85, 87, 89, and 91 on the north
<br />side of Manley Street and 2739 on the south side of Portsmouth Boulevard, where standard
<br />sidewalks do not now exist, is hereby authorized.
<br />
<br /> 2. That the abutting landowners shall be assessed at the rate of $3.00 per front
<br />lineal foot pursuant to a petition signed by seventy-five (75%) percent of the property
<br />owners affected by the requested improvements.
<br />
<br /> 3. That the City Clerk shall forthwith cause to be recorded an abstract of this resoluti
<br />together with a statement sho~ing the onwership and location of the property to be affected
<br />by the proposed sidewalk and the estimated amount that will be assessed against such abutting
<br />landowner in accordance with a statement of such amount on file in the office of the City
<br />Clerk."

<br /> City Council authorized the City Manager to advertise and sell city owned property
<br />located at 334 Effingham Street. The Portsmouth Psychiatric Center has submitted a bid of
<br />$132~S~Ofori~he 1Rnd and building currently being used by the Mental Health Services Board.
<br />Appropriation of this resolution will authorize acceptance of the bid as well as authorize
<br />conveyance of the title to the Portsmouth Psychiatric Center, Inc. A copy of the bid outlini
<br />the continued use of the property is attached for your information. The City Manager recom-
<br />mends adoption."

<br /> On motion of Mr. Barnes and seconded by Mr. Early, the following resolution was adopted,
<br />and by the folIowing vote:
<br />
<br />"A RESOLUTION ACCEPTING THE BID OF CENTER PSYCHIATRIST, INC. ro PURCHASE THE
<br />PROPERTY AT 334 EFFINGHAM STREET; AUTHORIZING THE CITY MANAGER TO CONVEY.
<br />
<br /> WHEREAS, by motion adopted by the Council of the City of Portsmouth on September 18,
<br />1979, the City Manager was authorized to advertise and receive'bids for certain City-owned
<br />property known according to the street numbering system as 334 Effingham Street; and
<br />
<br /> WHEREAS, notice of sale of said property has been duly advertised in accordance with
<br />Section 2.09 of the Charter of the City of Portsmouth; and
<br />
<br /> WHEREAS, the highest and best offer for purchase of the property and use thereof for
<br />the treatment of individuals for mental health purposes and related conditions was received
<br />from Center Psychiatrist, Inc. in'the amount of.One Hundred Thirty-two Thousand, Five Hundred
<br />Dollars ($132,5OO.).
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the bid of Center Psychiatrist, Inc. to purchase the hereinafter-described property for the
<br />sum of One Hundred Thirty-two Thousand, Five Hundred Dollars ($132,500.) be, and the same
<br />hereby is, accepted.
<br />
<br /> BE IT~URTHER RESOLVED that the City Manager be, and he hereby is, authorized to complete
<br />all transactions and execute all documents~incident to the conveyance of the following
<br />described property, to-wit:

<br /> All Chat certain piece or parcel of land, with the building and
<br />improvements thereon, known according to the present street numbering
<br />system as 334 Effingham Street, being the northern one-half of the parcel
<br />~shown on that certain plat prepared by Portsmouth Redevelopment ~ Housing
<br />Authority, dated January 1963 and recorded in the Clerk's Office of the
<br />Circuit Court of the City of Portsmouth, Virginia, in Map Book 4, p. 75.
<br />
<br /> It Being a portion of the property conveyed to the City of Portsmouth
<br />by deed dated August 26, 1975, from the Portsmouth area Mental Health
<br />Center, Inc., a Virginia Corporation, recorded in the aforesaid Clerk's
<br />Office in Deed Book 668, p. 461.'
