337 <br /> <br />December 11, 1979 <br /> <br />"A RESOLUT~ION ENDORSING THE CITY'S REQUEST FOR A WAIVER ON THE DEADLINE FOR <br />ACCEPTING APPLICATIONS FOR MODIFICATION OF A SECONDARY TREATMENT PLANT <br />REQUIREMENT ESTABLISHED BY tHE U. S. ENVIRONMENTAL PROTECTION AGENCY. <br /> <br /> WHEREAS, the regulations promulgated by the Environmental Protection Agency to establist <br />crite~i~ in acting upon applications for ~ssuance of a National Pollutant Discharge Elimina- <br />tion System (NPDES) permit which modifies the requirement of secondary'treatment under Sectio~ <br />301(h) of the Clean Water Act required the filing of application within ninety (90) days of t] <br />effective date of the regulation; and <br /> <br /> WHEREAS, the City was unaware of the deadline for the <br />advised by consultants that it was impossible to prepare a <br />(90) day time limit; and <br /> <br />preliminary application and was <br />full application within the ninety <br /> <br /> WHEREAS, <br />with outfalls <br />body of water; <br /> <br />s~udies indicate that upgrading to secondary treatment <br />· n the Elizabeth River would have no appreciable effect <br />and <br /> <br />by the existing plants <br />on the quality of that <br /> <br /> WHEREAS, it is estimated that the City can achieve approximately the same treatment <br />quality of its effluent without going completely to secondary treatment, thus, saving the <br />Federal taxpayers and the Portsmouth utility customers approximately $16,000,000. in capital <br />cost and a substantial amount in annual operating expenses; and <br /> <br /> WHEREAS, it would be irresponsible for the City of Portsmouth to blindly pursue the <br />up-grading of our secondary water plant with full knowledge that the taxpayer and customer <br />is not receiving a corresponding benefit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />this Council endorses the City's request for a waiver of the ninety (90) day requirement for <br />accepting an application for modification of the secondary treatment plant requirements so <br />that complete documentation of the City's alternate approach can be prepared." <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-458 "Consideration of a motion authorizing the <br />General Fund Contingency to the Fire Department's salary <br />fication, effective January 1, 1980. <br /> <br />transfer of $23,550 from the <br />catagory for payment of EMT certi- <br /> <br /> It is estimated that approximately 71 personnel <br />for EMT allowance on January 1, 1980. The <br />motion." <br /> <br />from the Fire Department will be eligibl( <br />also includes an additional 30 personnel <br />City Manager recommends adoption of this <br /> <br /> MotiOn of Mr. Bazmes and seconded by <br />$23,500 from the General Fund Contingency <br />and was adopted by unanimous vote. <br /> <br />Mr. Oast, that authorization be granted to transfer <br />to the Fire Department's salary category, as reques~ <br /> <br /> 79-455 "Consideration of a motion to transfer $247,323.00 from the Grants Contingency <br />Account to operate the Renovation of the Lightship Project, the Roadside Drainage Project, <br />the G~ounds~Clean~np and Park Repair Project, the Portsmouth RentA~men Project, the Central <br />Records Accelerated Micro-Film Project, and the Animal Care and Control Project. <br /> <br /> This motion will provide the funds necessary to continue operation of these seven projec~ <br />for up to twelve months. Funded entirely through the Comprehensive Employment and Training <br />Act, the projects will offer employment opportunities for low'income, unemployed residents <br />of the City as well as provide needed improvements for public facilities and grounds, anima~ <br />control, improved record keeping for the Police Department, and encourage more participation <br />in our Museums and LibYaries. The seven projects listed have already been approved by Counci~ <br />last fiscal year, but the additional sum zs requested to allow these projects to run their <br />maximum eligibility of 18 months. The City Manager recommends adoption of this motion." <br /> <br /> Motion of Mr. Beamer and seconded Oast, that authorization be granted to transfer <br />$247,323.00 from the Grants Contingency Account for seven projects, as requested and was <br />adopted by unanimous ~ote. ' <br /> <br /> 79-456 "Consideration of a motion to transfer $5,144 from the Grants Contingency <br />Account to continue to operate a Driver Training Program for residents of the Portsmouth <br />Drug Free Center. <br /> <br /> This ~otioJ will provide the funds necessary to operate this program for fiscal year <br />1980.. [g~ded entirely thro~lh the Comprehensige Employment and Training Act, this program <br />will offer classroom and behind=~he-wheel driver training through the public school~ to enhan¢ <br />the employment prospects of the Drug Free Center resiJents. The City Manager recommends <br />adoption of this motion." <br /> <br /> On motion of Mr. Gray and seconed by Mr. Oast, authorization was granted to transfer <br />$5,144 from the Grants Contingency Account, as requested, and was adopted by unanimous vote. <br /> <br /> 79-457 "Consideration of a motion authorizing the City Manager to enter into a contract <br />with the City of Suffolk and Coleman Place Properties, Inc. for the extension of water dis- <br />tribution lines, and wa~er service to the Wynnewood section of Suffolk. <br /> <br /> This contrast authorizes the City, through the Public Utilities Department or by sub- <br /> <br />e <br /> <br /> <br />
