Jones, Attorney, Fidelity American Bank Building, representing Holiday Inns <br />of America, spoke and requested that the matter to be deferred for thirty (30 days. <br /> <br /> Motion of Mr. Early and seconded by Mr. Beamer, that the ordinance to be deferred to <br />the second meeting in January (January 22, 1980), and was adopted by 6-1(Nay-Davis) vote. <br /> <br /> 79-448 The following crdinance approved on first reading at the regular meeting of <br />December 11, 1979, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $15,000 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />CAPITAL IMPROVEMENT CONTINGENCIES." <br /> <br /> On.motzon of Mr. Gray and seconded by Mr. Oast, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> -9-450 The following ordinance approved on first reading at the regular meeting of <br />December 11, 1979, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $700,000 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />THE STEP II DESIGN PHASE FOR SECONDARY tREATMENT UPGRADE OF THE PINNERS POINT <br />SEWAGE TREATMENT PLANT." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Early, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-434 - Th~ following report received from_the City Attorney <br />convey property to Star Bank Realty Corporation, deferred from the <br /> <br />concerning resolution to <br />meeting of November' 20, 19 <br /> <br /> "At the November 20, 1979 Council Meeting, you deferred action on Item 79-454 and direct <br />the office of the City Attorney to review and determine whether Section 2.09 of the Charter <br />of the City of Portsmouth required advertisement and public bid for the sale of the property <br />at issue. In addition, the Ccuncil authorized the City Manager, if necessary, to advertise a <br />receive bids for said property. <br /> <br /> The revaew of the applicable requirements of the Charter resulted in the rendering of an <br />Opinion by this office that the City should advertise and receive bids for the sale of the <br />property an issue. A Notice of Sale of City Froperty was advertised in the Virginian Pilot <br />for three consecutive days during the week of December 24, 1979 through January 3, 1980, <br />and bids were publicly opened on January 3, 1980. <br /> <br /> the only bid received was from Star Band Realty Corporation which proposes that the City <br />convey title to the subject triangular piece of land to Star Band Realty Corporation in ex- <br />change for Star Band Realty Corporation granting the City of Portsmouth an easement for the <br />8" sanitary sewer line across said property. <br /> <br />79: <br /> <br />~d <br /> <br />id <br /> <br /> <br />
