34-5 <br /> <br />January 8, 1980 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />the neighborhood of the proposed use; <br /> <br /> (b) Wi'tl~o%¢be detrimental to the public use or injurious to the property and <br />improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City <br /> <br /> 2. That Moses Gibson, Jr. is hereby granted a use permit pursuant to Section <br />Code of the City of Portsmouth, 1973, to operate a private social club pursuant to <br />40-73(b) of the City Code on land hereinafter-described: <br /> <br />Code. <br /> <br />40-73(b~, <br />Section <br /> <br /> o <br /> <br />ed road <br />with <br /> <br /> Beginning at a point on the south right-of-way of West Norfolk <br />Road approximately 1SO feet east of its intersection with Jordan Lane <br />and thence southerly along a private road approximately 2,800 feet; <br />thence east approximately 200 feet to establish the true Point of <br />Origin; thence northerly 53.4 feet; thence east 107.5 feet to the bank <br />of Carney Creek; thence southwest 99.84 feet; thence westerly 42.30 <br />feet; thence north 54.5 feet to the True Point of Origin. <br /> <br />This ~s6spermit is approved subject to the following condition: <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 79-442 On motion of Mr. Gray and seconded by Mr. Early, <br />approved on first reading at the Public Hearing of December 10, <br />following vote: <br /> <br />the following resolution <br /> 1979, was adopted, and by the <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO MR. AND MRS. THOMAS B. VELASCO TO <br />OPERATE A PRIVATE RESIDENCE AND HOME FOR THE ELDERLY NEAR THE INTERSECTION <br />OF UTAH STREET AND KINGMAN AVENUE. <br /> <br /> WHEREAS, Mr. and Mrs. thomas B. Velasco, made an application pursuant to Section 40-75(b) <br />Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafte <br />described; and <br /> <br /> WHEREAS, the applicants and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT R~SOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing and working <br />the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to property and improve- <br />ments in the neighborhood; and <br /> <br />Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. That Mr. and Mrs. Thomas B. Valasco are hereby granted a use permit pursuant to <br />Section 40-75(b), Code of the City of Portsmouth, 1973, to operate a private residen:e and <br />home for the elderly on property hereinafter-described: <br /> <br /> Beginning~at t~e northeast corner of Utah Street and Turnpike <br />Road; thence northerly along Utah Street 175 feet; thence easterly <br />200 feet; thence southerly 175 feet to Turnpike Road; thence westerly <br />200 feet to Utah Street; the Point of Origin. <br /> <br />Also known as 3736 Turnpike Road. <br /> <br /> 3. This u~'e~permit is approved subject to the following conditions: <br /> <br /> (1) No more than nine (9) elderly female guests shall be in the convalescent and <br />nursing home, <br /> <br /> (2) Persons operating the convalescent home shall reside on the second floor and the <br />guests will be residents of the first floor. <br /> <br /> This use is approved subject to the Commonwealth of Virginia approving and licensing the <br />operation of a convalescent and nursing home." <br /> <br /> 1. That Moses Gibson, Jr. shall maintain the upkeep of the grading of an unimprov- <br /> from West Norfolk Road to the point of origin hereindescribed in a manner commensurate <br />other private roads of like kind." <br /> <br /> <br />
