<br />AN OPEN STORAGE AREA FOR AUTOMOBILES, TRUCKS AND CONTAINERS
<br />SECTION OF HILL AVENUE AND WESLEY STREET.

<br />NEAR THE INTER-

<br /> WHEREAS, Portsmouth Terminals, Inc., made
<br />Code of the City of Portsmouth, 1973, for the
<br />and*
<br />
<br />an application pursuant to Section 47-.68.1(e), ~
<br />granting of a use permit as hereinafter-described;
<br />
<br /> WHEREAS, the applicant and the Planning Director have done ail things required to be done1
<br />in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permzt.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit hereinafter-described is sought:
<br />
<br /> (a) *Will hct adversely affect the health and safety of persons residing and working
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to property improvements
<br />in the neighborhood; and
<br />
<br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> 2. That Portsmouth Terminals, Inc., is hereby granted a use permit pursuant ~'~O Section
<br />40-68.1(e) of the Code of the City of Portsmouth, 1973, to operate an open storage area for
<br />automobiles, trucks and containers on property described hereafter subject to conditions set
<br />forth in paragraph (3) of this ordinance.
<br />
<br />Beginning at the northwest corner of Hill Avenue and Wesley Street;
<br />thence north along the west right-of-way of Hill Avenue, 449.3 feet;
<br />thence west 100 feet; thence north 50 feet; thence east 100 feet;
<br />thence west 1OO feet; thence north 30 feet; thence west 195 feet;
<br />thence southwest 215 feet; thence south approximately 360 feet; thence
<br />west 100 feet; thence south 25 feet to the north right-of-way of Wesley
<br />Street; thence east along said right-of-way 460 feet ro the Point of
<br />Origzn.

<br />3. This use permit is approved subject to the following conditions:
<br />
<br />Portsmouth
<br />Terminals,
<br />
<br />The City of Portsmouth will retain title to this property, leasing it to the
<br />Industrial Developmental Authority which, in turn, subleases such to Portsmouth
<br />Inc. until such time as the property is required for highway construction purposes.
<br />
<br /> (2) Portsmouth Terminals, Inc. recognizes that this property falls within the
<br />planned right-of-way for the Western Freeway Martin Luther King Freeway Interchange.
<br />
<br /> (3) This property will be properly fenced and be used to operate an open storage
<br />area for automobiles, trucks and containers."

<br /> 79-442 On motion of Mr. Early and seconded by Mr. Gray, the following resolution
<br />approved on first reading at the Public Hearing of December 10, 1979, was adooted, and by

<br />SOCIAL CLUB PURSUANT TO SECTION 40-73(b) OF THE CITY CODE ON LAND SITUATED ON
<br />THE BANKS OF CARNEY CREEK.

<br /> WHEREAS, Moses Gibson, Jr., made an application pursuant
<br />City of Portsmouth, Virginia, 1973, for the granting of a use
<br />and
<br />
<br />to Section 40-73(b), Code of the
<br />permit as hereinafter-described;
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required ~o be done
<br />in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
