The Seaboard <br />Coast Line Railway has agreed to the license agreement upon the payment of a one time fee <br />of $60.00. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A LICENSE AGREEMENT WITH <br />SEABOARD COAST LINE RAILROAD COMPANY FOR INSTALLATION OF PIPE LINE. <br /> <br /> WHEREAS, the City of Portsmouth obtained certain property <br />Suffolk, Virginia, for construction of a disposal facility for <br />Lake Kilby.Water Plant; and <br /> <br />located in the City of <br />sludge generated at the <br /> <br /> WHEREAS, the location of this disposal facility requires the construction of a force <br />main to transport the material from Lake Kilby ~o the site; and <br /> <br /> WHEREAS, the force main to be constructed will be partially located on proper~y of <br />the Seaboard Coast Line Railroad Company; and <br /> <br /> WHEREAS, the City of Portsmouth and Seaboard Coast Line Railroad Company have <br />a license agreement for the construction and maintenance of said force ma~n on the <br />of the railroad. <br /> <br />negotiated <br />property <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized to enter into a license agFeement <br />w~th Seaboard Coast Line Railroad Company for the construction, maintenance, repair, renewal, <br />operation, use and removal of a force main from Lake Kilby to the disposal facility," <br /> <br />Ayes: Barnes, Bea~er, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 80-15 " <br /> Consmderation of a resolution appointing viewers to close Moore s Lane and <br />an unnamed lane. <br /> <br /> the Portsmouth Redevelopment and Housing Authority has made application to close <br />Moore's Lane and an unnamed lane. This resolution will appoint viewers pursuant ~o state <br />law to make a recommendation to the City Council. The City Manager recommends adoption." <br /> <br /> O~ motion o£ Mr.' Oast and seconded by Mr. Gray, ~he following resolution was adoFted, <br />and by the followik~ vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF MOORE'S LANE AND AN UNNAMED <br />LANE. <br /> <br /> -WHEREAS, the Portsmouth Redevelopment And Housing Authority has made application to <br />vacate, close and discontinue the hereinafter-described streets, and it appearing that <br />notiee':.of,,app~lcatlon and request for the appointment of viewers was duly posted on December <br />13, 1979, on the bulletin board of the Circuit Court of the City of Portsmouth, the City <br />Hall building and the General District Court (Civil Division). <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmnu~h~. Virginia, <br />that A. N. Kendrick, Howard L. D~avis, George N. Powers, Sr., Reverend Clarence Robinson <br />and Reverend Warren Page be appointed viewers and that James Moss be appointed an alternate <br />viewer in the event one of the preceding viewers fails ro participate, said viewers to <br />view the hereinafter-described portion of such streets and to report to this Council in <br />writing whether in their opinion any, and if any, what in-convenience would result in <br />vacating and closing the following: <br /> <br />MOORE'S LANE <br /> <br /> All that certain piece or parcel of land situate, lying and being <br />in ~he City of Portsmouth', Virginia, known and designated as Moore's Lane as <br />show~n~th~at~certain plat entitled, "Plat Showing Clcsure Of Moore's Lane <br />In Block 11-48, Portsmouth, Virginia, For Portsmouth Redevelopment And <br />Housing Authority, Southside IV, Project CD-79", dated March 19, 1979, pre- <br />pared by Hassell And Folks, Surveyors and Engineers, Portsmouth, Virginia. <br />(S-79-14) <br /> <br /> <br />
