<br />· this easement was designed as part ef the Airline Boulevard drainage project;

<br />, subsequent to obtaining the hereinabove described easement, the Airlins Boulevard
<br />ect was redesigned leaving this easement with no further use or bensfit in the
<br />
<br /> WHEREAS, the contract purchaser of the property over which this easement is located
<br />has requested a release of the easement; and
<br />
<br /> WHEREAS, the said rights~o~v~and easement are no longer needed by the City of Ports-
<br />mouth and are, hereby, declared to be surplus.
<br />
<br /> NOW, THEREFORE· BE IT RESOLVED by the Council of the City of Portsmeuth, Virginia, that
<br />the City Manager be, and hereby is authorized to enter into a release of drainage easement on
<br />property on Chowan Drive near Airline Boulevard, said property being more fully described as
<br />follows:
<br />
<br />Beginning at the intersection of the west side of Chowan Drive with the north
<br />side of Airline Boulevard; thence north 09 19' 30" west along the western
<br />right~6f~wayof(JCh~m~n Drive a distance of 289.40' to a point, said point being
<br />the true po.iht of beginning: thence north 77° 47' 00" west 294.00' to a point
<br />on the western line of the property now or formerly owned by Co R. Crawford;
<br />thence north 5° 50' 19" west along the western line of said property 15.09' to
<br />a point; thence south 77° 47' 00" east 295.66 to a point on the western
<br />right-of-way of Chowan Drive; thence north 07 19' 30" east along said right-
<br />ofw~y a distance of 13.37' to the true point of beginning.

<br /> 80-3~ "Consideration of a resolution authorizing the construction and installation
<br />of sidewalks along Stratford Street from Greenwood Drive to Median Circle abutting 1300,1302,
<br />1304,and 1306 Stratford Street where standard sidewalks do not exist.

<br /> Certain abutting landowners have petitioned the City of Portsmouth for construction
<br />of a sidewalk on Stratford Street abutting 1300, 1302, 1304, and 1306. Notice has been
<br />delivered advising abutting landowners that a hearing would be held before City Council on
<br />January 22, 1980. 100~ of the affected landowners have signed the petition in accordance
<br />with State law. The City Manager recommends adoption."

<br /> On motion of Mr. Holley and seconded by Mr. Beamer, the following resolution was adopted
<br />and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE CONSTRUCTION AND INSTALLATION OF SIDEWALKS
<br />ALONG STRATFORD STREET FROM GREENWOOD DRIVE TO MEDIAN CIRCLE ABUTTING
<br />1300, 1302, 1304, 1306 STRATFORD STREET WHERE STANDARD SIDEWALKS DO NOT
<br />NOW EXIST, ASSESSING THE ABUTTING LAND OWNERS AT THE COST OF $3.00 PER
<br />FRONT LINEAL FOOT, AND DIRECTING THAT AN ABSTRACT OF THIS RESOLUTION
<br />BE RECORDED TOGETHER WITH A STATEMENT SHOWING THE ESTIMATED AMOUNT THA7 WILL
<br />BE ASSESSED AGAINST EACH SUCH LANDOWNER.
<br />
<br /> WHEREAS, by petition submitted in accordance with law certain abutting landowners have
<br />petitioned the City of Portsmouth to construct a sidewalk along Stratford Street from Greenwo~
<br />Drive to Median Circle abutting 1300, 1302, 1304, 1306 Stratford Street, where standard side-
<br />walks do not now exist, the cost thereof to be apportioned betwesn the City and the abutting
<br />landowners; and
<br />
<br /> WHEREAS, notice has been duly given to the abutting landowners, as provided by law,
<br />that a hearing would be held before the Council of the City of Portsmouth on January 22,
<br />1980, at 7:30 P.M. in the Council Chambers; and
<br />
<br /> WHEREAS, said hearing was duly held and in the judgment of the Council the said sidewalk
<br />should be constructed.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth:
<br />
<br /> Section 1: That the construction of a sidewalk along Stratford Street from Greenwood
<br />Drive to Median Circle abutting 1300, 1302, 1304, 1306 Stratford Street, where standard
<br />sidewalks do not now exist, is hereby authorized.
<br />
<br /> Section 2: That the abutting landowners shall
<br />front lineal foot pursuant to a petition signed by
<br />owners affected by the requested improvements.
<br />
<br />be assessed at the rate of $3.00 per
<br />seventyfive (75%) percent of the property
<br />
<br /> Section 3: rhat the City Clerk shall forthwith cause to be recorded an abstract of this
<br />resolution, together with a statement showing the ownership and location of the prcperty to
<br />be affected by the proposed sidewalk and the estimated amount that will be assessed against
<br />each abutting landowner in accordance with the statement thereof on file in her office."
