In addition, the <br />funds will be used to upgrade the existing facilities through purchase of various pieces <br />of equipment for use in the classrooms. The entire $4,000 is funded by the Virginia Commission <br />for the Arts and does not require any l~cal match. The City Manager recommends adoption. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer the transfer was approved by unanimous <br />vote. <br /> <br /> 80-66- Consideration of a motion authorizing the Director of Finance and the City <br />Treasurer to refund $2,498.72 to Chart House, Inc., for property located on George Washington <br />Highway related to off-site drainage assessment. <br /> <br /> The Engineering Department <br />drainage-~%~sessment and indicates that a <br />made iK t?his amount subject to~6% simple <br />Manager recommends adoption. <br /> <br />has recalculated based on State law the off-site <br />refund in this amount is due. The City <br /> <br />On motion of Mr. Early and seconded by Mr. Oast the mofiofi was adopted by unanimous vote. <br /> <br /> 80-67- Shbmission of the Employees Selection Review Activities for the fourth auarter <br />of the 1979 calendar year. <br /> <br /> This report includes the quarterly reporteof the Employees Selection Review, <br />EEO and Affirmative Action a~tivities for the fourth quarter and a general review of the EEO <br />and affirmative action statistics for 1979. The fourth quarter report indicates that the <br />hiring level continued to increass through the fourth quarter with females and minorities <br />keeping pace. The low performance levels experienced in the first and second quarters of 1978 <br />have be6n ~omple~ely~eliminated in the last 6 months and enable us to show good statistics with <br />an overall increase in hire. <br /> <br /> On motion of Mr. Oast and seconded by Mr. Barnes, the report will be received for <br />information. Mr. Holley asked that the report be forwarded to Attorney DeLacy Stith. <br />motion was approved and by unanimous vote. <br /> <br />This <br /> <br />-NEW BUSINESS- <br /> <br /> 80-70- Letter from Conrad Virginia Corporation, permission to address-City Council <br />in regards to an amendment zo Section 32-75 of the City Code: <br /> <br /> "Church's Fried Chicken, Inc. would'like to address City Council at its meeting on <br />February 12, 1980, in regards to an amendment to Section 32-75 of the Pcrtsmouth City Code. <br />We have undertaken construction in the 900 block of Airline Boulevard and second restaurant <br />in your city; and due to the curvature of the road and the location of other businesses in <br />that block, we would like to locate the base of our sign in the setback area. <br /> <br /> We would hope that City Council would entertain the proposal to allow for the erection <br />of signs in the setback area along Airline Boulevard. The development of Airline Boulevard <br />has been such that some businesses have located signs within the setback prior to the enactment <br />of the City Code. We, of oucrse, would be ready and willing to relocate the sign should the <br />city requmre the area to widen Airline Boulevard. <br /> <br />Thank you for-your consideration in this matter. <br /> <br /> Mr. Eddie Russell, attorney, representing Conrad Virginia Corporation, spoke in favor <br />of amending the City Code. <br /> <br /> On motion of Mr. Oast and seconded by Mr. Holley, this proposed amendment was referred <br />to the City Manager and the City A~torney for review, and by unanmmous vote. <br /> <br />80-71- Boards and Commissions-- There were no appointments made. <br /> <br /> 80-72-- R. L. Davis, 3200 High Street, representing Mr. Vernon Davis (deceased Police <br />Officer) spoke regarding his suggestion that Section 31-156 of the City Code, 1973 be amended <br />(formerly Section 26-83, 1961), retroactive to March 1, 1963. <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Holley, the item was referred to the City <br />Manager and the City Attorney for review. <br /> <br /> 80-73- On motion of Mr. Holley and seconded by Mr. Barnes the following resolution <br />was adopted and by the following vote: <br /> <br /> <br />
