<br />approved on first reading at the Public Hearing of April 7, 1980, was
<br />following vote:

<br />"A RESOLUTION GRANTING A USE PERMIT rO MARIE WILSON HARRIS TO OPERATE A DAY
<br />CARE CENTER PURSUANT TO SECTION 40-78(b).
<br />
<br /> WHEREAS,
<br />Marie Wilson
<br />1979; and
<br />
<br /> the Council of the City of Portsmouth, Virginia, granted a use permit to
<br />Harris to operate a day care center pursuant to Section 40-78[b) on May 8,
<br />
<br />Marie Wilson Harris has made an application pursuant to said section for the
<br />said use permit to allow additional children to be enrolled in the facility,
<br />
<br /> WHEREAS,
<br />amendment of
<br />and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done
<br />done in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. that the use for which the use permit hereinafter is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the
<br />~mprovements ~n the neighborhood; and
<br />
<br /> (c) Will be in accord with the purposes of the Zoning Chapter of
<br />
<br /> 2.

<br /> Marie Wilson Harris is hereby granted a use permit pursuant to Section 40-78(b)
<br />City Code to operate a day care center at the property described as follows:

<br /> Beginning on the west side of Elm Avenue approximately 8- feet south
<br />from its intersection with Ann Street; thence west 105 feet; thence south
<br />58 feet; thence east 105 feet to the west right-of-way of Elm Avenue; thence
<br />north 58 feet along said right-of-way to the point of origin.
<br />
<br /> 3. This use permit is approved subject to the following conditions:
<br />
<br /> (a) Thkt there not be more than twenty (20) children under six years of age
<br />enrolled at any one t~me in the facility as it exists today;
<br />
<br /> (b) That the owner must provide five (5) off-street parking soaces improved to
<br />City of Portsmouth's specifications prior to being given a certificate of occupancy."

<br /> 80-125 the following ordinance approved onffirst reading at the
<br />April 8, 1980, was taken up and read:

<br />"AN ORDINANCE TO APPROPRIATE $30,000 FROM THE CAPITAL IMPROVEMENT
<br />THE BALANCE OF THE CITY'S SHARE FOR THE VICTORY BOULEVARD EXTENSION
<br />PROJECT."
