June 24, 1980 <br /> <br /> On motion of Mr. Oast and seconded by Mr. Gray, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION APPOINTING YIEWERS FOR CLOSING OF A PORTION OF RUTTER STREEt. <br /> <br /> WHEREAS, Curtis Coan has made application to vacate, close and discontinue the herein- <br />after-described portion of Rutter Street, and it appearing that notice of application and <br />request for the appointment of viewers was duly posted on June 9, 1980, on the bulletin <br />board of the Circuit Court of the City of Portsmouth; the General District Court (Civil <br />Division) of the City of Portsmouth; and the City Hall Building of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that A. N. Kendrick, Henry P. Crowe, Jr. R. Wilke~son, Belvin W. Blachman, Frank N. Bilisoly <br />be appointed viewers and Harrison Miller be appointed an alternate viewer in the event one <br />of the preceeding viewers fails to participate, said viewers to view the hereinafter-describe~ <br />p~mtion of Rutter Street and to report to this Council, in writing, whether in their opinion <br />any, and if any, what inconvenience would result in vacating and closing the following <br />described street: <br /> <br />RUTTER STREET <br /> <br />B~'eginning on the west side of Peninsula Avenue as the same <br />would be extended 225 ft. from its intersection with the <br />south right-of-way with Columbia Street; thence west 305.95 <br />ft.; thence southwest 100 ft.; thence southeast 60 ft.; thence <br />east 344.62 ft. to the west right-of-way line of Peninsula <br />Avenue; thence north along the western right-of-way of Peninsula <br />Avenue 60 ft. to the point of beginning (S-69-6).' <br /> <br />Ayes: Barnes, Beamer, Eariy, Gray, HSlley, Oast, Davis <br />Nays: None <br /> <br /> 80-223 "Consideration of a resolution authorizing the construction and installation <br />of sidewalks along Median Circle from Greenwood Drive to Stratford Street abutting 201 <br />through 231 Median Circle (both inclusive) and 3803 Greenwood Drive where standard sidewalks <br />d6 not now exist. <br /> <br /> Certain abutting landowners have petitioned the City of Portsmouth to construct the <br />sidewalks along Median Circle from Greenwood Drive to Stratford Street. The cost, thereof, <br />to be apportioned between the City and the abutting landowners. Notice has been given to the <br />abutting landowners, as provided by law, that a hearing is to be held ondJune 24, 1980 by <br />the City Council. All affected landowners have signed the petition. The City Manager <br />recommends adoption." <br /> <br /> On motion of Mr. Beamer and seconded by Mr. Gray, the following resolution was adopted, <br />and b~ the following votE: <br /> <br />"A RESOLUTION AUTHORIZING IHE CONSTRUCTION AND INSTALLATION OF SIDEWALKS ALONG <br />MEDIAN CIRCLE FROM GREENWOOD DRIVE TO STRATFORD STREET ABUTTING 201 THROUGH <br />231 MEDIAN CIRCLE (BOTH INCLUSIVE) AND 3805 GREENWOOD DRIVE WHERE STANDARD <br />SIDEWALKS DO NOT NOW EXIST, ASSESSING.THE ABUTTING OWNERS AT THE COST OF $3.00 <br />PER FRONT LINEAL FOOT AND RIRECTING THAT AN ABSTRACT OF THIS RESOLUTION BE RE- <br />CORDED TOGETHER WITH A STATEMENT SHOWING THE ESTIMATED AMOUNT THAT WILL BE ASSE§SED <br />AGAINST EACH SUCH LANDOWNER. <br /> <br /> WHEREAS, by petition submitted in accordance with law, certain abutting landowners <br />have petitioned the City of Portsmouth to construct the sidewalk along Median Circle from <br />Greenwood Drive to Stratford Street abutting 201 through 231 Median Circle (both inclusive) <br />and 3805 Greenwood Drive where standard sidewalks do not now exist, the cost thereof to be <br />apportioned between the City and the abutting land-owners; and <br /> <br /> WHEREAS, notice has been duly given to the abutting landowners, as provided by law, <br />that a hearing would be held before the Council of the City of Portsmouth, Virginia, on <br />June 24, 1980, at 7:30 P. M. in the Council Chamber; and <br /> <br /> WHEREAS, the said hearing was duly held and in the judgment of the Council, the said <br />sidewalk should be constructed. <br /> <br />NOW, THEREFORE, BE IT RESOLVED~by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the construction of a sidewalk along Median Circle from Greenwood Drive to <br />Stratford Street abutting 201 through 231 Median Circle (both inclusive) and 3805 Greenwood <br />Drive, where standard sidewalks do not now exist, is hereby authorized. <br /> <br /> 2. That the abutting landowners shall be assessed at the rate of Fhree Dollars <br />($3.00) per front lineal foot pursuant to a petition signed by seventy-five percent (75%) <br />of the property owners affected by the requested improvements. <br /> <br /> 3. That the City Clerk shall forthwith cause an abstract of this resolution to be <br />recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, together <br />with a statement showing the ownership and location of the property to be affected by the <br />proposed construction of the sidewalk and the estimated amount that will be assessed <br />against each abutting landowner in accordance with the statement thereof on file in her <br />office." <br /> <br /> <br />
