That Zion Baptist Church is hereby granted a use permit pursuant to Section 40-72(b) <br />of the Code of the City of Portsmouth, 1973, to operate a church and place of worship on <br />property described herein subject to the conditions set forth in paragraph (5) of this <br />resolution. <br /> <br />Beginning at the northeast corner of King and Green Streets; thence north <br />along the east right-of-way of Green Street 115', more or less; thence <br />east 100'; thence south 115', more or less, to the north right-of-way <br />of King Street; thence west along said right-of-way to Green Street, the <br />~oint of origin. <br /> <br />3. This use permit is subject to the following conditions: <br /> <br /> (a) That any extension or exterior modification be reviewed and approved by the <br />Downtown D-1 Advisory Committee prior to issuance of any permit required by the City of <br />Portsmouth, Virginia." <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> Rev. G. Daniel Jones, Pastor, Zion Baptist Church, spoke in support of the petition <br />prior to the adoption of the resolution. <br /> <br /> 80-204 - The following ordinance approved on first reading at the Public Hearing of <br />June 9, 1980, was taken up and read: <br /> <br />"AN ORDINANCE AMENDING SECTION 40-68.1(e) OF THE CODE OF tHE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, PERTAINING TO SIGNS PERMITTED THROUGH THE ISSUANCE OF A USE PERMIT <br />WITHIN THE M-1-R ZONING DISTRICT." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, the ordinance was adopted, and by <br />the following vote: <br /> <br />Ayes: Barnes, Beamer, Early, Gray, Holley, Oast, Davis <br />Nays: None <br /> <br /> 80-204 On motion of Mr. Beamer and seconded by Mr. Gray, the following resolution <br />approved on first reading at the Public Hearing of June 9, 1980, was adopted, and by the <br />following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO ITT GWALTNEY, INC., TO OPERATE A FOOD <br />PROCESSING [RESEARCH AND DEVELOPMENT) AND WAREHOUSING PLAN~ ON ELMHURST LANE. <br /> <br /> WHEREAS, I%T ~Gwaltney~ne., pnrs~nt~to~Seetion~4D~6~l~e~. ~f~tke~CoJe ~ tke. City of <br />Portsmouth, Virginia, 1973, has petitioned for the granting of a use permit as hereinafter <br />described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, T~EREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />(1) That the use for which the permit hereinafter is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental zo the public use or injurious to property or improvemen <br />in the neighborhood; and <br /> <br />[~) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> (2) I~ Gwaltney, Inc. is hereby granted a use permit pursuant to Section 40~.%~(e) <br />of the Code of the City of Portsmouth, Virginia, to operate a food processing (research <br />and development) and warehousing plant on the property described as follows: <br /> <br />Beginning at a point at the northeast intersection of Garwood Avenue <br />and ElmhurstiLane and; thence in a northeasterly direction 670.27 <br />feet to a point; thence in a northwesterly direction 182.20 feet; <br />thence in a southwesterly direction along Phillipine Street 53.9 <br />feet; thence northwesterly 153.95 feet; thence northeasterly 57.03 <br />feet; thence northwesterly 270.39 feet: thence southwesterly 91.34 <br />feet; thence northwesterly 179.68 feet to the east right-of-way <br />line of Airline Boulevard; thence south-westerly along said right- <br />of-way of Airline Boulevard 437 feet, more or less; thence southerly <br />140 feet; thence westerly 255 feet to the north right-of-way line <br />of Elmhurst Lane; thence southeasterly along said right-of-way of <br />Elmhurst 838.17 feet, more or less, to the Point of Beginning. <br /> <br />(3) The following conditions are prescribed for this use permit: <br /> <br />(a) No animals or fowl are to be slaughtered as a part of the food processing; <br /> <br />(b) A laboratory for research and testing shall be used only for matters related <br /> <br />~S <br /> <br /> <br />
