<br />State law. A copy of their report and a map showing the portion to be closed is attached
<br />for your information. The City Manager recommends adoption."

<br /> Frederick J. Petzinger, III, has petitioned the City for the closing of a portion of
<br />Harrell Street west of the right-of-way line of Elm Avenue. this resolution appoints
<br />viewers in accordance with State law. The City Manager recommends adoption."

<br /> On motion of Mr. Gray and seconded by Mr. Barnes, the following resolution was adopted,

<br />'~'A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A PORTION OF HARRELL STREET.

<br /> WHEREAS, Frederick J. Petzinger, III, has made application to vacate, close and disconti~
<br />the hereinafter-described portion of Harrell Street, and it appearing that Notice of Applica-
<br />tion and Request for the Appointment of Viewers was duly posted on July 25, 1980, on the
<br />bulletin board of the Circuit Court of the City of Portsmouth , ~he City Hall
<br />Building and the General District Court (Civil Division) of the City of Portsmouth.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />A. N. Kendrick, Charles R. Hudgins, Robert Reid, Harrison Miller and R. Irvine Smith be
<br />appointed viewers and J. R. Wilkerson be appointed an alternate viewer in the event one of
<br />the preceding viewers fails to participate, said v~ewers to view the hereinafter-described
<br />portion of such streets and to report to this Council ~n writing whether in their opinion
<br />any, and if any, what ~nconvenmence wo~ld result in vacating and closing the following street

<br /> WHEREAS, by an easement agreement recorded in the Clerk's Office of the Circuit Court
<br />of the City of Portsmouth in Deed Book 69~, page 685, William A. Howell conveyed to the
<br />City of Portsmouth a utility easement for the purpose of installation of storm drainage in
<br />connection with the Paradise Creek drainage improvements; and
