Ayes: Barnes, Nays: None Abstaining: Whitlow Gray, Oast, Webb, Johansen 80-265 - On{?~otion of Mrs. Webb and seconded by Mr. Beamer, the following resolution approved on first reading at the Public Hearing of August 11, 1980, was adopted and by the following vote: (e) "A RESOLUTION GRANTING A USE PERMIT TO FLOURS INDUSTRIES, SWEETBRIER DEVELOPMENT COMPANY AND CONTINENTAL REAL ESTATE .COMPANY TO CONSTRUCT AND OPERATE A WHOLESALE BAKERY PRODUCTS DISTRIBUTION WAREHOUSE ON ELMHURST LANE. WHEREAS, Flours Industries, Sweetbrier Development Company and Continental Real Estate Company, pursuant to Section 40-71(b) of the Code of the City of Portsmouth, Virginia, 1973, have petitioned for the granting of a use permit as hereinafter,described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That th® use for which the permit is hereinafter sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to public use or injurious to property or improvements~ ii the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Flours Industries, Sweetbrier Development Company and Continental Real Estate Company are hereby granted a use permit pursuant to Section 40-71(b) of the Code of the City of Ports- mouth, Virginia, 1973, to operate a wholesale bakery products distribution warehouse on proper1 described as follows: Beginning at the northeast corner of Airline Boulevard and Elmhurst Lane; thence easterly along the north right of way of Airline Boulevard 250 feet; thence northerly 511.89 feet; thence north westerly 73.03 feet; thence westerly 14.97 feet; thence southwesterly 207,56 feet to the east right of way line of Elmhurst Lane; thence southerly 481.27 feet to the Point of Beginning. 3. The following conditions are prescribed for this use permit. (a) Outdoor lighting shall be properly designed so as not to create an adverse impact on adjacent residential properties. (b) Loading and unloading of trucks shall be conducted in an enclosed loading dock capable of containing noise generated by such operations so as not to adversely affect adjoiniJ residential property. Entrances from adjoining streets for delivery trucks shall be located on the subject property in such a manner as to be placed as far away from the enjoining resi- dential property as possible in conformance with accepted t'raffic control plans and procedures for such pmblic streets. (C) The applicant will construct appropriate screening from any enjoining residential property of a solid wall or fence or compact evergreen trees and/or shrub fence. (e) No building'permits will be issued prior to the submission to and approval by the City Engineer of a site plan evidencing the installation of the hereinabove required equipment or building procedures." Ayes: Barnes, Beamer, Gray, east, Webb, Whitlow, Johansen Nays: None 80-265 - On motion of Mrs. Webb and seconded by Mr. Gray, the following ordinance approve, on first reading at the Public Hearing of August 11, 1980, was adopted and by the following vote: (f) "AN ORDINANCE TO AMEND SECTION 40-48(3)(c) OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO CONSTRUCTION REQUIREMENTS FOR INTERNAL DRAINAGE IN PARKING LOTS."
