2 <br /> <br />August 26, 1980 <br /> <br />off-street parking, loading facilities, fencing or walls and an appropriate vegetation screen <br />from enjoining residential property composed of compact evergreen trees and/or shrub fences. <br />Failure of the Planning Commission to approve or disapprove said site at a regular monthly <br />meeting within sixty (60) days of the date the site plan is submitted shall be grounds for <br />an appeal to the City Council." <br /> <br />Ayes: Barnes, <br />Nays: None <br />Abstaining: Whitlow <br /> <br />Gray, Oast, Webb, Johansen <br /> <br /> 80-265 - On{?~otion of Mrs. Webb and seconded by Mr. Beamer, the following resolution <br />approved on first reading at the Public Hearing of August 11, 1980, was adopted and by the <br />following vote: <br /> <br />(e) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO FLOURS INDUSTRIES, SWEETBRIER DEVELOPMENT <br />COMPANY AND CONTINENTAL REAL ESTATE .COMPANY TO CONSTRUCT AND OPERATE A WHOLESALE <br />BAKERY PRODUCTS DISTRIBUTION WAREHOUSE ON ELMHURST LANE. <br /> <br /> WHEREAS, Flours Industries, Sweetbrier Development Company and Continental Real Estate <br />Company, pursuant to Section 40-71(b) of the Code of the City of Portsmouth, Virginia, 1973, <br />have petitioned for the granting of a use permit as hereinafter,described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That th® use for which the permit is hereinafter sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working in <br />the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to public use or injurious to property or improvements~ ii <br />the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Flours Industries, Sweetbrier Development Company and Continental Real Estate Company <br />are hereby granted a use permit pursuant to Section 40-71(b) of the Code of the City of Ports- <br />mouth, Virginia, 1973, to operate a wholesale bakery products distribution warehouse on proper1 <br />described as follows: <br /> <br /> Beginning at the northeast corner of Airline Boulevard and <br />Elmhurst Lane; thence easterly along the north right of way of Airline <br />Boulevard 250 feet; thence northerly 511.89 feet; thence north westerly <br />73.03 feet; thence westerly 14.97 feet; thence southwesterly 207,56 <br />feet to the east right of way line of Elmhurst Lane; thence southerly <br />481.27 feet to the Point of Beginning. <br /> <br />3. The following conditions are prescribed for this use permit. <br /> <br /> (a) Outdoor lighting shall be properly designed so as not to create an adverse impact <br />on adjacent residential properties. <br /> <br /> (b) Loading and unloading of trucks shall be conducted in an enclosed loading dock <br />capable of containing noise generated by such operations so as not to adversely affect adjoiniJ <br />residential property. Entrances from adjoining streets for delivery trucks shall be located <br />on the subject property in such a manner as to be placed as far away from the enjoining resi- <br />dential property as possible in conformance with accepted t'raffic control plans and procedures <br />for such pmblic streets. <br /> <br /> (C) The applicant will construct appropriate screening from any enjoining residential <br />property of a solid wall or fence or compact evergreen trees and/or shrub fence. <br /> <br /> (d) The City Manager is authorized <br />ques to determine the adequacy of the noise <br /> The cost associated with such measurements <br /> <br />to employ any sound' measuring equipment or techni- <br />containment procedures employed by the applicant. <br />or teSts shall be paid by the applicant. <br /> <br /> (e) No building'permits will be issued prior to the submission to and approval by the <br />City Engineer of a site plan evidencing the installation of the hereinabove required equipment <br />or building procedures." <br /> <br />Ayes: Barnes, Beamer, Gray, east, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 80-265 - On motion of Mrs. Webb and seconded by Mr. Gray, the following ordinance approve, <br />on first reading at the Public Hearing of August 11, 1980, was adopted and by the following <br />vote: <br /> <br />(f) "AN ORDINANCE TO AMEND SECTION 40-48(3)(c) OF THE CODE OF THE CITY OF PORTSMOUTH, <br /> VIRGINIA, 1973, PERTAINING TO CONSTRUCTION REQUIREMENTS FOR INTERNAL DRAINAGE IN <br /> PARKING LOTS." <br /> <br /> <br />
