Au?ust 26. ~9~q0 <br /> <br />Ayes: Barnes, Beamer, Gray, Oast Webb Whitlow, Johansen <br />Nays: None ' ' <br /> <br /> 80-273 - The following ordinance approved on first reading at the reg~larYmeeLing~df <br />August 12, 1980, was taken up and read: ~- <br /> <br /> "AN ORDINANCE TO APPROPRIATE $2?0,000 FROM THE CAPITAL IMPROVEMENT FUND FOR <br /> PHASE I1 OF THE 1846 COURTHOUSE RENOVATION (COMMUNITY ARTS CENTER)." <br /> <br /> On motion of Mr. Whitlow and seconded by Mr. Gray, the ordinance was adopted,zand by <br />the following vote: <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb Whitlow, Johansen <br />Nays: None ' <br /> <br /> 80-274 - The following ordinance approved on first reading at the regular meeting of <br />August 12, 1980, was taken up and read: <br /> <br /> "AN ORDINANCE FO APPROPRIATE $10,000 FROM FHE CAPITAL IMPROVEMENT FUND FOR <br /> DESIGN OF STREET IMPROVEMENTS FO DOULGAS PARK AND CHOATE STREET." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Whitlow, the ordinance was adopted <br />following vote: , <br /> <br />and by the <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow,$ohansen <br />Nays: None <br /> <br /> the following reports from the City Manager were presented: <br /> <br /> 80-305 "Consideration of an ordinance establishing one mosquito control district for <br />the City of Portsmouth in accordance with amnnd6d~State legislation. <br /> <br /> The City of Portsmouth established three mosquito control districts one each in 1957, <br />19S9, and 1967 for the purpose of insuring maximum funding under the State Code for mosquito <br />control d~stricts. The State of Virginia has now amended the Code which permits any governmenx <br />body which has more than one mosquito control district to consolidate into one single district <br />requiring one single board. The legislation provides that monies contributed to a consolidated <br />district shall have a whole harmless clause indicating that you would non receive any less <br />funding than that which was received by the individual districts. The consolidation also <br />removes the requirement of having a separate board for each mosquito control district. The <br />City Manager recommends adoption." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Barnes, the following ordinance was adopted on <br />first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE ESTABLISHING ONE MOSQUITO CONTROL DISTRICT FOR THE CITY OF <br />PORTSMOUTH IN ACSORDANCE WITH SEUTION 32.1-188 CODE OF VIRGINIA, 1950 <br />AS AMENDED." ' ' <br /> <br /> 80-306 "Consideration of a resolution authorizing the sale <br />of Norfolk for the Norfolk water line located in the right-of-wa)- <br />Line Railroad. <br /> <br />of an easement to the City <br />of the former Seaboard Coast <br /> <br /> The property has been appraised by a certified appraiser and the two cities are in agree- <br />ment that the methodology used by the appraiser is fair and equitable for a value of $40,880. <br />The sale of the easement and the purchase price has been officially communicated to the City <br />of No,folk and they have agreed to th~.~alue assdetermined by the appraisal. In accordance <br />with the Char~er of the City of Portsmouth, the sale of property between two political <br />subdivisions does not require public advertising prior to sale. The City Manager recommends <br />~doption." <br /> <br /> On motion of Mr. Oast and seconded by Mr. Barnes, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE SALE OF AN EASEMENT TO THE CITY OF NORFOLK, <br />VIRGINIA, FOR THE NORFOLK WATER LINES LOCATED IN THE FORMER RIGHT-DF-WAY <br />OF SEABOARD COAST LINE RAILROAD COMPANY PROPERTY. <br /> <br /> WHEREAS, the City of Portsmouth has purchased from the Seaboard Coast Line Railroad <br />Company the abandoned right-of-way extending across the City of Portsmouth from the western <br />branch of the Elizabeth River to Mt. Vernon Avenue; and <br /> <br /> WHEREAS, there is located within this property a City of Norfolk water main whic~ was <br />installed pursuant to an agreement between the City of Norfolk and the Railroad; and <br /> <br /> WHEREAS, the City of Norfolk, in order to retain the use of said property for its water <br />lines has agreed to purchase the hereinafter-described easement from the City of Portsmouth fo~ <br />the agreed appraised value of Forty Thousand, Eight Hundred Eigh%y' Dollars ($40,840.); and <br /> <br /> WHEREAS, the conveyance of the hereinafter-described easement will not adversely affect <br />the use of the property or disposition thereof by the City of Portsmouth; and <br /> <br /> <br />
