HOLLAND, SR. TO CONSTRUCT <br /> AND OPERATE A CONVALESCENT OR NURSING HOME ON PROPERTY ON POWHATAN AVENUE. <br /> <br /> WHEREAS, Warren L. Holland, Sr., owner of certain hereinafter described property, pursuar <br />to Section 40-75(b)of the Code of the City of Portsmouth, Virginia, 1973, has petitioned <br />for the granting of a use permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit is sought for the construction and operation of a <br />convalescent or nursing home: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working in <br />the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to property or improvement <br />in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Warren L. <br />of the Code of the <br />or nursing home on <br /> <br />Holland, Sr. is hereby granted a use permit pursuant to Section 40-75(b) <br />City of Portsmonth, Virginia, 1973, to construct and operate a convalescen <br />property described as follows: <br /> <br /> Beginning at a point on the west side of Powhatan Avenue, <br />said point being 216.10 feet south from the intersection of <br />Powhatan Avenue and Griffin Streets; thence south along Pow- <br />hatan Avenue 60 feet; thence west 505 feet, more or less; <br />thence northwest 145 feet, more or less; thence north 10 feet, <br />more or less, to the property now or formerly owned by Seaboard <br />Coast Line Railroad Company; thence northeast along the said <br />Seaboard Coast Line Railroad property 480 feet; thence south <br />125 feet, more or less, thence southeast 8S feet, more or less; <br />thence east 5 feet, more or less; thence south 20 feet, more or <br />less; thence east 90 feet to the west right of way of Powhatan <br />Avenue, the Point of Beginning. <br /> <br />3.
