In accordance with <br />the law the cost will be apportioned between the City and the abutting land owners. Notice <br />has been given to all abuting land owners that the hearing is to be held by City Council on <br />September 23, 1980. Thirteen of the 17 affected land owners have signed the petition. The <br />City Manager recommends adoption." <br /> <br /> Ms. Margaret McDaniel, 800 Dorset Avenue, spoke concerning the moving of shrubbery and <br />trees and Requested that crepe myrtles be planted. <br /> <br /> On motlon of Mr. Beamer and seconded by Mr. Gray, the following resolution was adopted, <br />and by the following vote: <br /> <br />'~A RESOLUTION AUTHORIZING THE CONSTRUCTION AND INSTALLATION OF SIDEWALKS <br />ALONG THE NORTH SIDE OF DORSET AVENUE FROM RAPIDAN STREET TO TAZEWELL STREET <br />ABUTTING 600, 602, 604, 606, 700, 702, 704, 706, 708, 800, 802, 806, 808, 810, <br />~812~AND 814 DORSET AVENUE AND 2544 STOWE STREET WHERE STANDARD SIDEWALKS DO <br />NOT NOW EXIST, ASSESSING THE ABUTTING LAND-OWNERS AT THE COST OF $3.OO PER <br />FRONT LINEAl FOOT, AND DIRECTING THAT AN ABSTRACT OF THIS RESOLUTION BE RE- <br />CORDED TOGETHER WItH A STATEMENT SHOWING THE ESTIMATED AMOUNT THAT WILL BE <br />ASSESSED AGAINST EACH SUCH LANDOWNER. <br /> <br /> WHEREAS, by petition submitted in accordance with law, certain abutting landowners have <br />petitioned the City of Portsmouth to construct a sidewalk along the north side of Dorset Avenu~ <br />from Rapidan Street To Tazewell Street abutting 600, 602, 604, 606, 700, 702, 704, 706, 708, <br />800, 802, 806, 808, 810, 812 and 814 Dorset Avenue and 2544 Stowe Street where standard sidewa <br />do not now exist, the cost thereof to be apportioned between the City and the abutting landown <br />and <br /> <br /> WHERE~S, notice has been duly given to the abutting landowners, <br />a hearing will be held before the Council of the City of Portsmouth, <br />23, 1980, at 7:30 P. M. in the Council Chambers; and <br /> <br />as provided by law, that <br />Virginia, on September <br /> <br /> WHEREAS, said hearing was duly held, and in the judgment of the Council, the said sidewal] <br />should be constructed. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the city of Portsmouth, Virginia: <br /> <br /> 1. That the construction of a sidewalk along the north side of Dorset Avenue from <br />Street to Tazewell Street abutting 600, 602, 604, 606, 700, 702, 704, 706, 708, 800, 802, 806, <br />808, 810, 812 and 814 Dorset Avenue and 2544 Stowe Street where standard sidewalks do not now <br />exist+, is~hereby:authorized. <br /> <br /> 2. That the abutting landowners shall be assessed at the rate of Three Dollars ($3.00) <br /> per front lineal foot pursuant to a petition signed by seventy-five percent (75%) of the <br /> property owners affected by the requested improvements. <br /> <br />~" ~ 3. That the City Clerk shall.forthwith cause to be recorded in the Clerk's Office of <br /> the Circuit Court of the City of Portsmouth, Virginia, an abstract of this resolution, to- <br /> gether with a statement showing the ownership and location of the property to be affected by <br /> the prop.osed sidewalk and the estimated amount that will be assessed against each abutting <br /> landowner in.accordance with the statement thereof and to maintain an abstract of this resolu- <br /> tion and said statement showing ownership and location of the property and the estimated <br /> amount that will be assessed against each abutting landowner in her office." <br /> <br /> Aves: Beamer, Gray, oast, Webb, Whitlow, Johansen <br /> Nays: None <br /> <br /> 80-354 - "Consideration of a motion authorizing the Director of Finance to refund <br />$3,051.71 to Portsmouth Doctors Building, Inc for over assessment on off-site drainage. <br /> <br /> This refund is being made du~ to an error in calculation for run-off in establishing the <br />assessment fOr~-'.off-site drainage costs. The amount being refunded has been mutually agreed <br />to by both parties. The City Manager recommends adoption of this motion." <br /> <br /> <br />
