<br />"A RESOLUTION REQUESTING THAT THE MAYOR OF THE CITY OF PORTSMOUTH ESTABLISH
<br />A CONSUMER ADVISORY COMMISSION.
<br />
<br /> WHEREAS, the City Council recognizes the mounting concern in the area of consumer protec
<br />tion regarding the home improvement industry; and
<br />
<br /> WHEREAS, the City Council is concerned that the public confidence is being undermined
<br />in those furnishing such services, the majority of whom operate with integrity and sincere
<br />regard for the consumer; and
<br />
<br /> WHEgEAS,i.:th,e Council concludes that the State should take steps, both protective and
<br />preventive, to educate the consumer about such practices, to assist the public in obtaining
<br />relief from such practices and to prevent such practices from occurring.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED that ~he Mayor is requested to establish a Consumer Advise
<br />Commission for a period of one (1) year to monitor the effectiveness of the available remedie
<br />to persons a:ffected by unlawful consumer practices in the home improvement industry and to
<br />ma~e Te~commendations, if any, on the enactment of additional State legislation for the protec
<br />tion of the consumer."

<br />Mrs. Gail Kettlewell, S Alton Parkway, made the following presentation:

<br /> "I am speaking as President of the Federation of Civic Clubs as we urge you to adopt
<br />~hD,~.eso~A~iDn establishing a Mayor's Consumer Advisory Commission~in the city. We would
<br /> further urge the earliest possible naming of the commission so that it may begin its work
<br /> monitoring the new state law for home improvement contractors and considering the need for
<br /> consumer education in our city.
<br />
<br /> We thank the city staff for their prompt response to the Federation's request for the
<br />commission.
<br />
<br /> You will find attached to this statement a listing of the now thirty-two club membership
<br />in the Federation of Civic Clubs."

<br /> Motion of Mr. Beamer and seconded by Mrs. Webb, that authorization be granted to transfer
<br />$160,000 from the Grants Contingency Account, as requested, and was adopted by unanimous vote.
<br />
<br /> 80-284 - "Consideration of a motion authorizing the City Assessor to abate and the City
<br />Treasurer to refund $51.92 plus interest and penalty paid thereon on the. property located at
<br />1315 Spratley Street, deferred from the meeting of August 12, 1980."
<br />
<br /> Motion of Mr. east and seconded by Mrs. Webb, that authorization be granted to refund
<br />$51.92 plus interest and penalty paid On property located at 1315 Spratley, as requested,
<br />and was adopted by unanimous vote.
<br />
<br /> The follOwing reports from the city Manager were presented:
<br />
<br /> 80-350 - "Consideration of an ordinance on first reading to appropriate $90,000 from
<br /> the Capital Improvements Fund for repairs and waterproofing application to the Crawford Stree~
<br /> Parking Garage.
<br />
<br /> This appropria'tion will provide the necessary funds to repair concrete cracks, scraping
<br />and sanding necessary to apply a neoguard traffic bearing waterproofing application. The
<br />surface~o~f the parking garage requires attention immediately. Since Winter is fast approachi~
<br />precipitation, freezing, and thawing will cause more damage if the strface area is not ad-
<br />dressed within the next 6 weeks. Recovery Will be sought in accordance with the provisions of
<br />the construction contract. The City Manager recommends adoption on irst reading."

<br /> On mo~io~ of Mr. east and seconded by Mrs. Webb, the following rdinance was approved on
<br />first reading, and by unanimous vote:

<br /> Motion of Mr. Gray and seconded by Mr. Beamer, that the contract to be awarded to
<br />Richmond Primoid, Inc., as ~reqnested, and was-adopted by unanimous vote.
<br />
<br /> 80-3S1 - "Consideration of a resolution authorizing the City Manager to convey City owned
<br />property located at the intersection of Rose Avenue and Deep Creek Boulevard known as Highland
<br />Biltmore Community Center.
<br />
<br /> ©n September 15, 1980, the City received bids in accordance with the advertisement for
<br />sale for this parcel which had been previoUsly declared surplus. The only bid received for
<br />the property was from the Portsmouth Church of the Nazarene in the amount of $6,000. The
