November 28, 1980 <br /> <br />on the 12th day of November, 1980, on the~bulletin board of ~he <br />Portsmouth, General District Court (Civil Division) of the City <br />Domestic Relations District Court of the City of Portsmouth. <br /> <br />Circuit Court <br />of Portsmouth, <br /> <br />of the City of <br />and Juvenile an~ <br /> <br /> NOW, THEREFORe, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that A. <br />N. Kendrick, Howard L. Davis, George Newton Powers, Sr., Clarence Robinson, and James Moss be <br />appointed viewers and that James H. Griffin be appointed an alternate viewer in the event that <br />one of the preceding viewers fails to participate, said viewers to view the hereinafter-des- <br />cribed portion of such street and to report to this Council in writing whether in their opinioI <br />any, and if any, what inconvenience would ~esult in vacating and closing the following street: <br /> <br />WALDRON AVENUE <br /> <br /> Beginning at the southeast intersection of Waldron Avenue and Deep <br />Creek Boulevard as shown on the plat of Virginia Place, recorded in <br />Map Book 17, page 73, in the Clerk's Office of the Circuit Court of the <br />City of Chesapeake, Virginia, and thence runnmng in an easterly direction <br />along the southern side of Waldron Avenue approximately 420', which is <br />the northeast corner of Lot 17 as shDwn on said plat; thence northerly <br />30' along the same line as if the eastern line of said Lot 1- had been ex <br />tended in a northerly direction to a point on the northern side of Waldron <br />Avenue; thence in a westerly direction along the northern side of Waldron <br />Avenue to Deep Creek Boulevard; thence southerly 30' along the boundary <br />of Deep Creek Boulevard to the Point of Beginning." <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 80-423 "Consideration of a resolution accepting the proposal of th.e Virginia Department <br />of Highways and Transportation relating to construct, ion of the second downtown tunnel and <br />authorizing the City Manager to execute such documents necessary. <br /> <br /> The City has received a proposal from the Virginia Department of Highways and Transporta- <br />tion which includes an option to purchase the right-of-way needed for the second downtown <br />crossing of the Elizabeth River. This option includes .003 acres of land in fee, 1.29 acres <br />~ermanent easement and 5.446 acres in temporary easement. The Highway Department has offered <br /> 438,936 as the fair market value determined by appraisers for the property. This resolution <br />will authorize acceptance of the offer as well as authorizing the City Manager to execute <br />documents related to the tunnel easements. The City Manager recommends adoption of the reso- <br />lution.'' <br /> <br /> On motion of Mr. Gray and seconded by Mr. Barnes, the following resolution was <br />and by the following vcte: <br /> <br /> "A RESOLUTION ACCEPTING THE PROPOSAL OF THE DEPARTMENT OF HIGHWAYS AND TRANS- <br /> PORTATION OF THE COMMONWEALTH OF VIRGINIA RELATING TO CONSTRUCTION OF THE <br /> SECOND DO~NTOWN TUNNEL AND ~UTHORIZING THE CITY MANAGER TO EXECUTE SUCH <br /> DOCUMENTS AS MAY BE NECESSARY TO COMPLETE THIS TRANSACTION. <br /> <br />adopted, <br /> <br /> WHEREAS, the Department of Highways and Transportation of the Commonwealth of Virginia <br />desires to acquire right-of-way and permanent and temporary easements needed for the construc- <br />tion of the second downtown tunnel; and <br /> <br /> WHEREAS, the Department of Highways and Transportation of the Commonwealth of Virginia ha <br />appraised the value of the right-of-way needed and the permanent and temporary easements re- <br />quired for said construction as Four Hundred Thirty-eight Thousand, Nine Hundred Thirty-six <br />Dollars ($438,936.); and <br /> <br /> WHEREAS, the construction of said downtown tunnel is of such importance to <br />Portsmouth that the conveyance of such right-of-way and permanent and temporary <br />supersede the need of the City for said property and such is hereby declared to <br /> <br />the City of <br />easements <br />be excess; and <br /> <br /> WHEREAS, the Department of Highways and Transportation is an agency of the Commonwealth o <br />Virginia; and <br /> <br />may <br />or <br /> <br />WHEP~EAS, Section 2,O9[b) of the Charter of the City of Portsmouth provides that the City <br />sell or convey property to the Commonwealth of Virginia, any political subdivision thereof <br />to the Federal Government without advertisement and without receiving bids therefor. <br /> <br /> NOW, THEREFORe, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that th <br />proposal of the Department of Highways and Transportation of the Commonwealth of Virginia to <br />acquire the right-of-way and permanent and temporary easements as hereinafter-described for th <br />sum of Four Hundred Thirty-eight Thousand, Nine HunJred Thirty-six Dollars [$438,936.) be, and <br />the same hereBy'{~, accepted. <br /> <br />Parcel OO1 -.Being as shown on Sheet 6 of the plans for Route Z64, State Highway Pro- <br />ject O264-124-105, RW-201, and lying on the north (left) side of 1-264 westbound <br />land certerline and adjacent to the existing north right of way and limited access- <br />line of present Route 264 from the lands of Graydon P. McGinley opposite approximate <br />Station 0+53 to the south existing right of way line of present Green Street opposite <br />approximate Station 0+79 and containing 0.003 acres, more or less, land; and being <br />all of the seme land acquired by the landowner [rom Suburban ~nvestment Company <br />by deed dated March 31, 1966 and recorded in Deed Book 467, Page 350, in the office <br /> <br /> <br />
