Z59 <br /> <br />~ovember 25, 1980 <br /> <br /> 80-421 "Consideration of a resolution accepting the proposal of the Virginia Department <br />of Highways and Transportation to purchase certain property adjacent to Churchland Boulevard. <br /> <br /> The Virginia Department of Highways and Transportation has offered to purchase riDht-of- <br />way and easement for construction and relocation of public utilities in connection with improv <br />ments to rowne Point Road and Churchland Boulevard.~The p~operty is required by the Virginia <br />Department of Highways and Transportation in connection with the Poplar Hill and Towne Point <br />Road Project scheduled for advertising in the Spring of 1981. The total amount of land to be <br />purchased is .003 of an acre at a cost of ~606. A copy of a letter from the Superintendent of <br />SchooLs concurring in the sale of the right-of-way is'attached for your information. The <br />City Manager recommends adoption." <br /> <br /> On motion of Mr. Beamer and seconded by Mrs. Webb, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION ACCEPTING THE PROPOSAL OF THE DEPARTMENT OF HIGHWAYS AND TRANS- <br />PORTATION OF THE COMMONWEALTH OF VIRGINIA TO PURCHASE CERTAIN PROPERTY <br />ADJACENT TO CHURCHLAND BOULEVARD. <br /> <br /> WHEREAS, the Department of Highways and Transportaion of the Commonwealth of Virginia <br />desires to purchase certain City-owned property adjacent to Churchland Boulevard for the <br />purpose of road widening; and <br /> <br /> WHEREAS, the Department of Highways and Transportation of the Commonwealth of Virginia <br />has offered to purchase said property from the City of Portsmouth for the sum of Six Hundred, <br />Six ($606.) Dollars for the fee simple interest in the property and for an additJonal temporar <br />construction easement and utility easement to be used in connection with said road widening <br />project; and <br /> <br /> WHEREAS, said property is no longer needed by the City of Portsmouth or the Portsmouth <br />School Board and is hereby declared to be excess; and <br /> <br /> WHEREAS, the Department of Highways and Transportation is an agency of the Commonwealth <br />of Virginia; and <br /> <br /> WHEREAS, Section 2.O9(b) of the Charter of the City of Portsmouth provides that the City <br />may sell or convey property to the Commonwealth of Virginia, any political subdivision thereof <br />or to the Federal Government without advertisement and without receiving bids therefor. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the proposal of the Department of Highways and Transportation of the Commonwealth of Virginia <br />to purchase the hereinafter-described property for the sum of Six Hundred, Six ($606.) Dollar: <br />be, and the same hereby is, accepted. The property to be purchased is described as follows: <br /> <br /> Ail that certain piece or parcel of land situate in the City of <br />Portsmouth, Virginia, being shown on Sheet 70 of the plans for "Poplar <br />Hill and Towne Point Roads, State Highway Project UOOO-I31-107, R/W 201", <br />and lying on the south (right) side of Churchland Boulevard survey <br />centerline and adjacent to the existing south right-of-way line of present <br />Churchland Boulevard from the lands of Churchland Baptist Church opposite <br />approximate Station 16 48 to a point in the lands of the landowner <br />opposite approximate Station 17 + 72, and containing 0.003 acres, more <br />or less, land, together with the temporary right and easement to use <br />the additional areas shown as being required for the proper construction <br />of cut and/or fill slopes containing 0.017 acres, more or less. Said <br />~emporary easement will terminate at such time as the construction of <br />the aforesaid project is completed, and being a part of the same land <br />acquired by the landowner from the City of Ghesapeake by Annexation <br />Order dated May 10, 1966, recorded in Common Law Order Book 66, page <br />5S7, in the Clerk's Office of the Circuit Court of the City of Chesapeake, <br />Virginia. <br /> <br /> BE IT FURTHER RESOLVED that the CitT Manager be, and he hereby is, authorized to execute <br />such documents as may be neccessary to complete this transaction." <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 80-422 - "Consideration of a resolution appointing viewers for the closing of a portion <br />of Waldron Avenue. <br /> <br /> Gladys D. Harvey, Arthur J. Stewart and Laura Stunnette have made application to vacate <br />and close portion of Waldron Avenue. This resolution appoints viewers pursuant to State. <br />law for a report back to City Council. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Oast and seconded by Mrs. Webb, the following resolution was adopted <br />and by the following vote: ' <br /> <br /> 'A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A PORTION OF WALDRON <br /> AVENUE. <br /> % <br /> WHEREAS, Gladys D. Harvey, Arthur J. Stewart, and Laura Stunnette, have mad~application <br />to vacate, close and discontinue the hereinafter-described portmon of Waldron Avenue, and it <br />appearing that notice of application and request for the appointment of viewers was duly posted <br /> <br /> <br />
