Oast, Jr., <br />Gloria O. Webb, Morton V, Whitlow, Robert T. Williams, City Manager, <br />Steven Lieberman, City Attorney <br /> <br />Absent: Jack P. Barnes <br /> <br />land <br /> <br />80-438 Public Hearing on rezoning and use permit applications, a proposal to alter <br />use of the Peachtree PUD-72-1, and possible amendment of the City Code: <br /> <br />(a) Zoning Petition Z 80-21 Petition of Viola J. and Joseph L. Holmes, Owners. <br /> <br /> Carroll O. Ferrell, Attorney, 820 Citizens Trust Building, representing the petitioner, <br />spoke for the petition's approval and stated that the property would be converted into a <br />nice office building that would not be degrading to the neighborhood, but an asset. <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Gray, to concur in the recommendation of <br />Planning Commission, Zoning Petition Z 80-21 was denied, and by the following vote: <br /> <br />the <br /> <br />Ayes: Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> (b) Zoning Petition Z 80-22 Petition of Joseph V. O'Brien, Owner. <br /> <br /> Joseph V. O'Brien, Owner, 2861 Meadow Wood Court, Chesapeake, asked for approval of <br />the petition. <br /> <br /> On motian of Mr. Beamer and seconded by Mr. Gray, to concur-in the recommendation of the <br />Planning Commission, and the following ordinance was approved on first reading by unanimous <br />vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 80-22" <br /> <br />(c) ZONING PETITION Z 80-24 Petition of Drive-In Theatres, Inc., by Louis H. Cohen, <br /> Secretary. <br /> <br /> James Steiger, Attcrney, 1 Commercial Place, Norfolk, representing the petitioner, <br />requested that the matter to be continued until the next meeting because of the change df <br />interest rates to study the feasibility of building the project and would not ask for rezonin <br />until petitioner can determine if the project will be built. <br /> <br /> On motion of Mr. Whitlow and seconded by Mr. Gray, to concur in the recommendation of <br />the Planning Commission, the following ordinance was approved on first reading, and by unani- <br />mous vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 80-24" <br /> <br />(If the petitioner desires to defer the matter on second reading, it was requested <br />that a letter be submitted prior to the meeting on Friday for deferral.) <br /> <br /> (d) Zoning Petition Z 80-25 Petition of the City Planning Commission. <br /> <br /> On motion of Mr. Oast and seconded by Mrs. Webb, to concur in the recommendation of the <br />Planning Commission, the following ordinance was approved on first reading, and by unanimous <br />vote: <br /> <br />"ZONING AMENDMENT ORDINANCE 2 80-25" <br /> <br /> (e) Zoning Petition Z 80-26 - Petition of the City Planning Commission. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, to concur in the recommendation of the <br />Planning Commission, the following ordinance was approved on first reading, and by unanimous <br />vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 80-26" <br /> <br />(f) Zoning Petition Z 80-28 Petition of P. H. Boyette, Jr., and Company, Inc., <br /> Contract Owner. <br /> <br /> P. H. Boyette, Jr., Owner, 650 Frederick Boulevard, spoke for the petition and requested <br />the pet~ti~u be ~msnded R-100 instead of R~75-S, as this would be in accordance with the <br />COMPLAN. <br /> <br /> Bob Stell, President of Churchland West Civic League, 3717 Red Barn Road, spoke in <br />favor of the unanimous recommendation of the Planning Commission to deny the petition, and <br />to deny the request of R-100 by the petitiGner.
