263 April 28, 1981 (c) Consideration of an ordinance to 1973, by amending Section 145, pertaining or landfill. amend the Code of the City of Portsmouth, Virginia, to charges for handling refuse at City incinerator This ordinance will increase the fee for handling refuse at the City incinerator from the current $8 per ton to ~9.23 per ton. In addition the fee for handling refuse at the City landfill will increase from the current $3 per ton to $4 per ton. The corresponding minimum fees also reflect increases. These charges apply only to non-residents and commercial operators. (d) Consideration of an ordinance to amend Section 14-41 of the Code of the City of Portsmouth, Virginia, 1973, pertaining to increasing the service charge for dumpmaster con- tainers. This ordinance will increase the charges for dumpmaster container service by approximate] 10%, the exact increase depending upon container size and the number of collections per week. (e) Consideration of an ordinance to amend the Code of the City of Portsmouth, Virginia, 19-73, by amending Section 24-100~a) pertaining to fees at the City Park Golf Course. This ordinance will increase the fees at the City Park Golf Course by 50~ per round, and by corresponding amounts for annual and special rates. (f) Consideration of an ordinance to amend the Code of the City of Portsmouth, Virginia, 1973, by amending Section 6-8, pertaining to charges for permits for and inspection of elevators, etc., in the City. This ordinance will establish a fee of ~20 for annual inspection of all elevators in buildings.in, the City. In addition, a $23 fee is included for annual weight testing as required by the BOCA Code. Only one reading is required for the above ordinances. They are included on this agenda because of their relation to the total budget considerations. The action on these o~dinances may be deferred until second reading on the budget if the Council so desires. Motion of Mr. Whitlow and seconded by Mr. Beamer, that items (a)(b)(c)(d)(e) and (f) be deferred To the next meeting (May 12, 1981), and was adopted by unanimous vote. 81-151 "Consideration of an ordinance to appropriate funds the City Government for and during the Fiscal Year beginning July l~8g. necessary for operation of 1, 1981 and ending June 30, This ordinance will provide the necessary funds for the 1981=82Fiscal Year for each of the City's 13 operating funds. The City Manager recommends adoption on first reading." On motion of Mr. Whitlow and seconded by Mrs. Webb, the following ordinance was approved on first reading, and by unanimous vote: "AN ORDINANCE TO APPROPRIATE FUNDS NECESSARY FOR FOR AND DURING THE FISCAL YEAR BEGINNING JULY 1, UNFINISHED BUSINESS OPERATION OF THE CITY GOVERNMENT 1981 AND ENDING JUNE 30, 1982." 81-11- - On motion of Mrs. Webb and seconded by Mr. Gray, approved on first reading at the Public Hearing of April 13, following vote: .the following resolution 1981, was adopted and by the (b) "A RESOLUTIOh GRANTING A USE PERMIT TO MARTHA JOE CAMPBELL AND ADMINISTRATORS-MOTHER'S DAY OUT TO OPERATE A DAY NURSERY/CHILD RIVER SHORE BAPTIST CHURCH. MISTY M. TAYLOR, CARE CENTER AT WHEREAS, Martha Joe Campbell and Misty M. Taylor, Administrators Mother's Day Out, made an application pursuant to ¢40-73(b) of the Code of the City of Portsmouth, Virginia, 1973 fo~ the granting of a use permit as hereinafter-described; and ' WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, NOW, (1) in the neighborhood the Planning Commission has recommended the granting of said use permit. THEREFORE, BE IT RESOLVED by the Council of the City of PortsmQuth, Virginia: That the use for which the use permit hereinafter is sought: (a) Will not adversely affect the health and safeny of persons residing or working of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in acaord with the purposes of the Zoning Chapter of the City Code. (2) Martha Joe Campbell and Misty M. Taylor, Administrators-Mother's Day Out, is hereby granted a use permit pursuant to Section 40-73(b) of the City Code to operate a Day Nursery/Chz Care Center at the property described as follows:
