<br /> Substitute motion of Mr. Gray and seconded by Mr. Barnes, the matter be referred to the
<br />City Attorney, and was adopted by unanimous vote.
<br /> 81=242 !'Consideration of a resolution requesting Senator Harry F. Byrd, Jr., and
<br />Senator John W. Warner to introduce into the United States Senate companion legislation to
<br />H.R. 3314 which provides for payments to local governments in lieu of property taxes on
<br />property oyqed by the Federal Government.
<br /> On-April 29, 1981, Representative G. William Whitehurst introduced a Paym.ents-in-
<br />lieu of Taxes Bill (H.R.3314) into the House of Representatives to provide for payments to
<br />local governments in lieu of taxes for Froperty exempt from property taxation under Federal
<br />law which is located within the jurisdiction of the local government and owned by the United
<br />States, a foreign government, or an internatlonal organization. Such a proposal, if fully
<br />funded, Would yield to the City approximately $23,850,000 based on the FY 1982 tax rate of
<br />$1.35 per $100 valuation. This resolution urges Senators Byrd and Warner to introduce a
<br />companion bill in the Senate which is similar to Representative Whitehurst's. The City
<br />
<br />Manager recommends adoption."

<br />"A RESOLUTION URGING SENATOR HARRY F. BYRD, JR. AND SENATOR JOHN W. WARNER TO
<br />INTRODUCE AND TO SEEK ADOPTION AND FUNDING BY THE CONGRESS OF THE UNITED STATES
<br />OF A PROGP,~dM OF PAYMENTS TO LOCAL GOVERNMENTS IN LIEU OF PROPERTY TAXES ON
<br />PROPERTY OWNED BY THE FEDERAL GOVERNMENT.
<br />
<br /> WHEREAS, local governments are often deprived~ofisnhstgnzial revenues which would be
<br />collectible ifproperty owned by the Federal Government was subj.ect to tax as private propert>
<br />and
<br />
<br /> WHEREAS, the location of property owned by the Federal Government places continued de-
<br />mands on local governments for urban services without commensurate return to the local
<br />government; and
<br />
<br /> WHEREAS, the impact of a substantial amount of Federal property within the boundaries
<br />of local government jurisdiction creates an immense burden on the remaining tax base to suppor-
<br />services required by private and federal property; and
<br />
<br /> WHEREAS, the value of Federal real proFerty in the City of Portsmouth is estimated at
<br />$1,766,724,630., an amount which reduces the total City property value by fifty three percent
<br />(53%); and
<br />
<br /> WHEREAS, Representative G. William Whitehurst has introduced a Payments In Lieu Of Taxes
<br />Bill~,.(HR 3514) into the House of Representatmves to provide for payments to local governments
<br />in il~u"of taxes for property exempt from property taxation under Federal law which is located
<br />within the jurisdiction of the local government and owned by the United States, a foreign
<br />government or an international organization; and
<br />
<br /> WHEREAS, such a proposal, if fully funded, would yield to the City approximately $23,850
<br />based on the FY-1982 tax rate of $1.35 per $100. valuation; and
<br />
<br /> WHEREAS, passage of such legislation would do much to improve public services in the City
<br />of Portsmouth as well as to deflate artificially high local tax rates.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that
<br />Senator Harry F. Byrd, Jr. and Senator John W. Warner are urged to introduce and to seek
<br />adoption and funding by the United ~States Senate of companion legislation to HR 3314 which will
<br />provide for payments to local governments in lieu of property taxes on property owned by the
<br />Federal Government.

<br /> BE IT FURTHER RESOLVED that the City Clerk be, and she hereby ~s, directed to forward
<br />a certified copy of this Resolution ro Senator Harry F. Byrd, Jr. and Senator John W. Warner."

<br /> 81-243 "Consideration of a resolution authorizing the City Manager to release an ease-
<br />ment.fo~dpublic utilities in a portion of former Griffin Street.
<br />
<br /> Portions of Griffin Street extending from the southside of the Crawford Connector to the
<br />northern boundary of the Seaboard Coast Line Railroad have been closed by ordinances adopted
<br />by City Council. The City retained an easement in said former Griffin Street for the purpose
<br />of operating and maintaining public utilities. Whereas, the public utilities have now been
<br />relocated and the City no longer has a need for the easement; this resolutien authorizes the
<br />City Manager ro release said easement. The City Manager recommends adoption."

<br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE AN EASEMENT FOR PUBLIC
<br /> UTILITIES IN A PORTION OF FORMER CRIFFIN STREET.
<br />
<br /> WHEREAS, by ordinances adopted hy the Council of the City of Portsmouth, Virginia, on
<br />September 11, 1973 and August 23, 1977, portions of Griffin Street extending from the south-
<br />side of the Crawford Connector ro the northern boundary of the Seaboard Coast Line' Railroad
<br />Company right-of-way were closed; and
