<br /> WHEREAS, Peck Equipment Company of Virginia, Inc. has requested that the City execute a
<br />Quitclaim Deed zn order to correct the boundary description of said property; and
<br />
<br /> WHEREAS, Carlee Realty Corporation, and subsequent owners of said property, have complied
<br />with all conditions and terms of the 1959 conveyance of said property.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager be, and he hereby is, authorized to execute a Quitclaim Deed in order to
<br />correct the boundary description and the conveyance of real property by the City of Portsmouth
<br />to Carlee Realty Corporation b) Deed dated July 10, 1959, recorded in the Clerk's Offlce of
<br />the Circuit Court for the City of Portsmouth, Virginza, in Deed Book 533, Page 485."

<br /> 81-279 "ConsiJeration of a resolution releasing a portion of twenty foot maintenance
<br />easement along the north side of the Portsmouth Seawall.
<br />
<br /> The construction of the Crawford Harbor Apartment Building has resulted in several
<br />encroa, eh~ents on City property and City easements because of the description in the original
<br />plats. The correct surve) indicates that the two parcels mentioned in this resol~tien
<br />encroach on the maintenance easement which was dedicated to the City for the purpose of
<br />repairs and maintenance of the Seawall around the north harbor. This resolution releases
<br />any rights the City has on these two small parcels and the Engineerzng Department has indicate
<br />that such release will not hamper the maintenance or repair of the Seawall itself. The City
<br />Manager recommends a&option."

<br /> On motion of Mrs.. Webb and seconded by Mr. Barnes, the following resolution was adopted,
<br />and by the roll. owing vote:

<br />THE NORTH SIDE OF THE PORTSMOUTH SEAWALL; INSTRUCTING THE CITY
<br />EXECUTE A DEED OF RELEASE.

<br /> WHEREAS, by a plat recorded in the Clerk's Office of the Circuit Court ~f the City of
<br />Portsmouth, Virginia, in Map Book 11, Page 49, the Portsmouth Redevelopment And Housing
<br />Authority dedicated a twenty foot maintenance easement along the north side of the Portsmouth
<br />Seawall adjacent to "Parcel B" as shown on said plat for the purpose of maintaining the
<br />concrete Seawall; an~ '
<br />
<br /> WHEREAS, a portion of said maintenance easement is now required for the constru6tion of
<br />th~ Crawford Harbor Tower Apartment Project; and
<br />
<br /> WHEREAS, said hereinafter-described portion of such easement is no longer required by
<br />the City of Portsmouth and is hereby declared to be excess.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City of Portsmouth hereby releases any and all right, title or interest in and to the
<br />hereinafter-described portion of said twenty foot maintenance easement along the north side
<br />of the Portsmouth Seawall, to-wit:
<br />
<br /> All those certain pieces or parcels of land designated as Parcels 1
<br />and 2 on that certain plat entitled "Physical Survey Of Parcel "B" Crawford
<br />Harbor Project", dated April 7, 1981, prepared by Robert T. Addison g Associates,
<br />Ltd., reference to which plat is hereby made for a more particular description
<br />of said property.
<br />
<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute
<br />a Deed of Release of the hereinabove-described prcperty and such other documents as may be
<br />necessary to complete this transaction.'

<br /> 81-280 "Consideration of a motion authorizing, the refund of $370.15 to Virginia Housing
<br />and Development Authority (VHDA) representzng real estate taxes paid and collected in error.
<br />
<br /> This motion authorizes the refund of $370.15 to Virginia Housing and Development Authorit~
<br />(VHDA) representing real estate taxes paid on property located at 3614 Gregory Court for the
<br />period August 28, 1980 to June S, 1981. This property was owned during that period by VHDA
<br />which is tax exempt. The City Manager recommends adoption."
<br />
<br /> Motion of Mrs. Webb and seconded by Mr. Whitlow, that
<br />$370.15 to the Virginia Housing and Development Authority,
<br />unanimous vote.

<br /> Motion of Mr. Gray and seconded by Mr. Beamer, that authorization be granted to refund
<br />$70.80 to Mr. George A. Schnebli, Jr., as requested, and was adopted by unanimous vote.
