On February 22, 1977, Council ratified <br />an earlder, resolution authorizing R. T. Williams, City Manager, and John A. Howell, Jr., <br />Director of Public Utilities, to act in a similar manner. The City Manager recommends <br /> <br />adoption." <br /> <br /> On motion of Mrs. G~K~ and seconded by <br />and by the following vote: <br /> <br /> "A RESOLUTION RATIFYING THE AUTHORIZATIONS <br /> TO THE ENVIRONMENTAL PROTECTION AGENCY FOR <br /> <br />Barnes, the following resolution was adaopted <br /> <br />PREVIO'USLY MADE FOR THE CITY TO APPLY <br />FEDERAL FUNDS TO CONSTRUCT WASTE <br /> <br />WATER TREATMENT FACILITIES; AUTHORIZING THE CITY MANAGER AND DIRECTOR OF PUBLIC <br />UTILITIES TO DO WHATEVER IS NECESSARY TO APPLY FOR SUCH GRANT. <br /> <br /> WHEREAS, the Council of the City of Portsmouth has <br />and Director of Public Utilities to sign an application <br />tion of waste water treatment facilities; and <br /> <br />previously authorized its City Manage~ <br />for federal funds for the construc- <br /> <br /> WHggEAS, an application is now being made for Phase III of the plan for the construction <br />of waste water treatment facilities. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />Council ratifies the authorizations previously made for the City to apply to the Environmental <br />Protection Agency for federal funds to construct waste water treatment facilities. <br /> <br /> BE IT FURTHER <br />Director of Public <br />documents incident <br />ment facilities." <br /> <br />RESOLVED that G. Howell, Jr., <br />Utilities, are authorized to complete all transactions and execute all <br />to applying for federal grants for the construction of waste water treat- <br /> <br />Ayes: Barnes, Beamer, Gray, east, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 81-278 - "Consideration of a resolutzon authorizing the City Manager to execute a <br />Quitclaim Deed on property formerly conveyed by the City of Portsmouth to Carlee Realty <br />CorForation ~Portland Street and Broad Street). <br /> <br /> In 1959, the City conveyed 3.418 acres of land located at the southwest corner of <br />Portland Street and Broad Street to Carlee Realty Corporation. That property is now being <br />purchased and a survey for the description has determined that the 1959 deed from the City <br />was zncorrect in the description of the western boundary of the property. This problem can <br />best be corrected by the City now giving the new owner a Quitclaim Deed with the correct <br />boundary desdription. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Gray, the following resolution was adopted, <br />and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A QUITCLAIM DEED ON <br /> PROPERTY FORMERLY CONVEYED BY THE CITY OF PORTSMOUTH TO CARLEE REALTY <br /> CORPORATION (PORTLAND STREET AND BROAD STREET). <br /> <br /> WHEREAS, by deed dated July 10, i959, recorded in the Clerk's Office of the Circuit <br />Court of the City of Portsmouth, Virginia, in Deed Book 335, Page 485, the City of Portsmouth <br />conveyed certain real property located at the southwest intersection of Portland Street and <br />Br~ad Street, containing 3.418 acres to Carlee Realty Corporatmon; and <br /> <br /> WHEREAS, Peck Equipment Company of Virginia, Inc. has recently contracted to purchase <br />said pa[.q~ of real property; and <br /> <br /> WHEREAS, a current physical survey of said property indicates that the descriptmon <br />contained in the 1959 deed from the City of Portsmouth to Carlee Realty Corporation was in- <br />correct in ~ts description of the western boundary of said property; and <br /> k <br /> WHEREAS, it was the intent of the 1959 deed from the City of Portsmouth to Car5ee Realty <br />Corporation to convey the entire parcel then owned by the City of Portsmouth; and <br /> <br /> <br />
