<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFO~ BE IX RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit hereinafter-described 'is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing and working
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or im-
<br />provements in the neighborhood; and
<br />
<br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> 2. That Pentecostal Workers of Christ
<br />40-71(b) of the Code of the City of Portsmouth,
<br />and educational building on property described
<br />paragraph 3 of this resolution.
<br />
<br />is hereby granted a use permit pursuant to Secti,
<br /> 1973, to operate a church and place of worship
<br /> herein subject to the conditions set forth in
<br />
<br /> Beginning on the southwest corner of Deep Creek Boulevard and Evergreen Place;
<br />thence south along the west right-of-way of Evergreen Place 115'; thence west
<br />110!, more or less; thence south 75', more or less; thence west 100' to the east
<br />right-of-way of Nashville Avenue; thence north along said right-of-way 82.3' to
<br />the south right-of-way of Deep Creek Boulevard; thence northeasterly along said
<br />right-of-way to Evergreen Place, the point of origin.
<br />
<br />3. This use permit is approved subject to the following condition:
<br />
<br /> (a) The use permit wou.ld be considered revoked unless building permits are issued a~
<br />construction of the proposed educational wing is under way within one (1) year from the date
<br />the adoption of this Resolution."

<br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973,
<br />AS AMENDED, BY AMENDING SECTION 40-71[b), PERTAINING TO USES IN COMMERCIAL
<br />C-2 DISTRICT."

<br />
<br /> 81-296 - The'.following ordinance approved on first reading at the regular meeting of
<br />August 11, 1981, was taken up and read:
<br />
<br />"AN ORDINANCE TO APPROPRIATE $614,000 FROM THE CAPITAL IMPROVEMENT FUND FOR
<br />DRAINAGE IMPROVEMENTS IN THE MID-CITY AREA (D-S) AND STREET IMPROVEMMENTS IN
<br />WESTHAVEN PARK (S-5)."

<br /> On motion of Mr. Whitlow and seconded by Mr. Gray, the ordinance was adopted, and by the
<br />following vote:

<br /> Motion of Mr. Gray and seconded by Mrs. Webb, that the contract for construction to be
<br />awarded to Suburban Grading and Utilities, Inc.; contract for the pipe to be awarded.to
<br />Lone Star Industries, being the lowest responsible bidders, and was adopted by unanimous vote
<br />
<br /> 81-29- The following ordinance approved on first reading at the regular meeting of
<br />August 11, 1981, was taken up and read:
<br />

<br /> "AN ORDINANCE TO APPROPRIATE $550,000 FROM THE CAPITAL IMPROVEMEN~ FUND FOR
<br /> EQUIPMENT REPLACEMENT."
