<br /> 81-290 On motion of Mr. Gray and seconded by Mr. Barnes, the following resolution ap-
<br />proved on first reading at the Public Hearing of August 10, 1981, was adopted and by the
<br />following vote:
<br />
<br />"A RESOLUTION GRANTING A USE PERMIT TO REVEREND ROBERT G. THOMPSON OF THE
<br />PORTSMOUTH BAPTIST ASSOCIATION TO OPERATE A PLACE OF WORSHIP AT 636 HIGH
<br />STREET.
<br />
<br /> WHEREAS, Annette M. Preddy, by Goodman-Segar-Hogan, Agent, on behalf of Reverend Robert
<br />Thompson of the Portsmouth Baptist Association, made application pursuant to Section 40-72(b)
<br />of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting of a use
<br />permit as hereinafter-described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />.in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />(1) That the use for which the use permit hereinafter is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or
<br />improvements in the neighborhood; and
<br />
<br />(c) Will be ~n accord with the purposes of the Zoning Chapter of the City of Code.

<br />Reverend Robert G. Thompson of the Portsmouth Baptist Association is hereby granted
<br />pursuant to Section 40-72(b) of the Code of the City of Portsmouth, Virginia to
<br />house of worship at the property described as follows:
<br />
<br /> Beginning on the north side of High Street and west 2S', more or less,
<br />from its intersection with Green Street; thence north 85'; thence east 45',
<br />more or less; thence south 85' to the north right-of-way of High Street;
<br />thence west along said right-of-way 45', more or less, to the point of origin.
<br />
<br />(3) This use permit is approved subject to the following conditions:
<br />
<br /> (a) Upon approval of this use permit, the applicant
<br />Inspector's Office for a Fire Prevention Inspection and must
<br />and recommendations as set forth through this inspection.
<br />

<br /> (b) Upon approval of this use permit, all plans and specifications for the construc-
<br />tion, reconstruction or alteration of the property must be submitted for review and approval b

<br /> (c) Ail permits for construction, alteration or renovation of said property must be
<br />secured not latsr than November 1, 1981.
<br />
<br /> (d) That the structure meets all City Code requirements of a place of public assembl
<br />during the time it is authorized to operate as a house of worship, and that all such'improve-
<br />ments required by said Code be completed prior to the use of the property as a place of worsh~
<br />
<br /> (e) That the use permit is issued to Reverend Robert G. Thompson and the Po?tsmouth
<br />Baptist Association and is not transferable to any other person or church or any premises or t
<br />any new structure erected on the premises, and that any transfer of such use permit mhst be
<br />recommended by the Planning Commission and approved by City Council.
<br />
<br /> (f) The maximum number of persons occupying this facility at anyone time, cpmbining
<br />both counselling and worship services, will not exceed that number specified by the Building
<br />Inspector's Offise in their Fire Prevention Application.
<br />
<br /> (g) The operation of this facility will only be between the hours of 8:00 a. m. and
<br />S:OO p. m. seven (7) days a week."

<br /> WHEREAS, Pentecostal Workers of Christ, by mastor James H. Coppage, made an application
<br />pursuant to Section 40-71(b) of the Code of the ~ity of Portsmouth, 1973, as amended, for the
<br />granting of a use permit as hereinafter-describe~; and
