37,O <br /> <br />October 13, 1981 <br /> <br /> Motion of Mr. Gray and seconded by Mr. Beamer, That authorization be granted to transfer <br />229,000 from Grants Continegency Account, as requested. <br /> <br /> Substitute motion of Mr. Oast and seconded by Mrs. Webb, to concur in the recommendation <br />of the City Manager, that the matter be tabled, and was adopted by unanimous vote. <br /> 81-375 "Consideration of a motion to terminate Night Maxi-Ride Service and reduce <br />the hours of operation of the Churchland Maxi-Ride Service. <br /> The State funded experimental Night Ride Service has never attracted anticipated <br />ridership and with State funding about to end, the City is not in a position to fund the <br />deficit. It is proposed to terminate that service. Churchland Maxi-Ride has low ridership~- <br />during the first morning hour and the 1st evening hour and it is proposed to shorten ser- <br />vice by those two hours. The City Manager recommends adoption." <br /> <br /> Motion of Mr. Beamer and seconded by Mrs. Webb, to concur in the <br />the City Manager, to terminate Night Maxi-Ride Service and reduce the <br />of the Churchland Maxi-Ride Service, was adoFted by unanimous vote. <br /> <br /> 81-376 "Consideration of a motion to abate and refund <br />assessed and paid in error. <br /> <br /> This mo~ion will authorize the abatement and refund of <br />Taxes, to Mr. Edward E. Godden in error, and was <br /> <br /> 81-377 "Consideration of an ordinance to amend the Code of the City of Portsmouth <br />by amending Sections 35-2 and 35-3 pertaining to penalties for nonpayment of real estate <br />and personal property tax. <br /> <br /> The City Charter provides for the imposing of a penalty for nonpayment of taxes as <br />may be prescribed by ordinance, provided such penalty shallnot exceed the maximum which is <br />provided by State law. The applicable portion of the State Code permits a 10% penalty and <br />this ordinance increases the amount of the penalty in the City Code. The City Manager <br />recommends adoption.' <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following ordinance was adopned <br />on first and final reading, and by the following vote: <br /> <br /> "AN ORDINANCE TO ~MEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br /> BY ~qENDING SECTIONS 35-2 AND 35-3 PERTAINING TO PENALITIES FOR NONPAYMENT <br /> OF REA1 ESTATE AND PERSONAl PROPERTY 1AX. ' <br /> <br />Ayes: <br />Nays: <br /> <br />Be~mer, Gray, Oast, Webb, Whitlow, Johansen <br />None <br /> <br /> 81-378 On motion of Mr. Oast and seconded by Mr. Gray, the following resolution <br />adopted, and by the following vcte: <br /> <br />THE OPPOSITION OF THE COUNCIL OF THE CITY OF <br /> <br />"A RESOLUTION EXPRESSING <br />PORTSMOUTH TO ANY EXPANSION OR UNNECESSARY PROLONGATION OF THE USE OF <br />THE CRANEY ISLAND DISPOSAL AREA AND DIRECTING THE CITY MANAGER AND THE <br />CITY ATTORNEY TO TAKE WHATEVER STEPS ARE NECESSARY IN SUPPORT OF THE <br />COUNCIL'S POSITION ON THIS MATTER AT SUCH TIMES AND IN SUCH FORUMS AS <br />MAY BE NECESSARY. <br /> <br />was <br /> <br /> WHEREAS, the Army Corp of Engineers has recently announced that it expects to implement <br />a Five Year Management Plan which will permit the extension of the life of Craney Island <br />as a disposal area for an additional thirty-six (36) years to approximately 2017 and the <br />raising of the elevation by approximately fifteen (15) feet to approximately plus thirty <br />(+30) feet mean sea level; and <br /> <br /> WHEREAS, such plan is contrary to the findings and conclusions contained in a document <br />entitled "Norfolk Harbor And Channels, Virginia, Deepening And Disposal Feasibility Report", <br />dated September, 1979, as prepared by the Army Corp of Engineers, which recommended against <br />the raising of the current design level and expansion to the west of the Craney Island <br />Disposal Area; and <br /> <br /> WHEREAS, the Craney Island Disposal Area is within the boundaries of the City of <br />Portsmouth and its ultimate development as a deep water marine terminal, a freeport, and <br />related industrial and commercial development is vital to the economic vitality of the <br />City of Portsmouth and the Commonwealth of Virginia; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth has steadfastly expressed by Resolution <br />its opposition to the expansion of the Craney Island Disposal Area; and <br /> <br /> WHEREAS, the Council <br />Engineers, in prepara[ion <br />Regulations regarding the <br /> <br />of the City of Portsmouth questions whether the Army Corp of <br />of its Managemen~ Elan has met the mandates required by Federal <br />environmental and economic impact of the Plan. <br /> <br /> <br />
