July 10, 2001 <br /> <br />Financial Impact: <br /> <br />· There will be no negative financial impact on the City. <br /> <br />· The cost of enforcement will be reduced by the proposed increase in administrative <br /> fees from $75.00 to $150.00. <br /> <br />· The cost for removal of inoperative motor vehicles will be passed on to the property <br /> owner. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 23-1, 23-4, 23-8(b), <br />23-26, 23-27, 23-28, 23-29, 23-30, 23-46, 23-48 AND 23-50 THEREOF, BY <br />ENACTING NEW SECTIONS 23-10 AND 23-91 THROUGH 23-96 THERETO, AND BY <br />REPEALING SECTIONS 23-3 AND 23-49, THEREOF PERTAINING TO <br />NUISANCES." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01 - 207 - Adoption of a resolution in support of the proposed application by the <br />Commonwealth Railway to the Virginia Department of Rail and Public Transportation for <br />railway improvements at the Cedar Lane crossing in Portsmouth. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution in support of the proposed application by Commonwealth <br />Railway to the Virginia Department of Rail and Public Transportation for railway <br />improvements at the Cedar Lane crossing in Portsmouth. <br /> <br />Purpose and Need: <br /> <br />· Commonwealth Railway is applying to the Virginia Department of Rail and Public <br />Transportation for funding under the Rail Preservation Program to perform general track <br />maintenance that includes the installation of cross-ties, surfacing of the track, and <br />improvements at the Cedar Lane grade crossing in Portsmouth. <br /> <br />· Beginning in 1990, the Virginia General Assembly, through an amendment to House <br />Bill 30, established and has continued to fund the Rail Preservation Program which is <br />designed to assist railroads across the State in rehabilitation and preservation of rail <br />lines. <br /> <br />· An important factor for Commonwealth Railway's continued rail safety and <br />maintenance program is that three of their customers, one in Suffolk and two in <br />Portsmouth (Celanese, Ltd. and BASF), transport hazardous materials through highly <br />urbanized areas. <br /> <br />· One of the criteria in the application process is adoption of a resolution from the <br />localities where the work is to be performed. <br /> <br />Financial Impact: <br /> <br />· All program funding is provided by the State and the participating railroad with no <br />monies required from the local municipality. <br /> <br />· The estimated cost of the improvements to the Cedar Lane grade crossing project is <br />$7O,5OO. <br /> <br /> <br />
