July 10, 2001 <br /> <br />(e) S-01-05 <br /> <br />DOWNTOWN NEIGHBORHOOD - Ordinance granting the request <br />of the Portsmouth Redevelopment and Housing Authority for the <br />closure of that portion of Apple Street located between King Street <br />and County Street. The Comprehensive Plan encourages the <br />closure of unneeded rights-of-way that do not have traffic or land <br />access functions. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Pitts, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE CLOSING AND VACATING A PORTION OF APPLE STREET <br />LOCATED BETWEEN KING STREET AND COUNTY STREET." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />(f) S-01-06 <br /> <br />LONG POINT NEIGHBORHOOD - Ordinance granting the request <br />of David R. Clark for the closure of that portion of Breakwater Drive <br />east of Flagship Way. The Comprehensive Plan encourages the <br />closure of unneeded right-of-way that do not have traffic or land <br />access functions. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to grant the applicant's <br />request to defer consideration of S-01-06 to the public hearing meeting of July 24, 2001, <br />and was adopted by unanimous vote. <br /> <br />- City Manager's Report - <br /> <br />01 - 206 - Adoption of an ordinance modifying Chapter 23, Nuisances, of the Code of <br />the City of Portsmouth, Virginia to include legislative changes enacted by the General <br />Assembly dealing with reasonable notice, the creation of regulations to address drug <br />blight, administrative changes, and revisions related to vehicles stored in the City <br />compound. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance amending Chapter 23, "Nuisances," of the Code of the City <br />of Portsmouth, Virginia to bring the code into compliance with changes in the State <br />Code as well as other administrative revisions. <br /> <br />Purpose and Need: <br /> <br />· The citizens of the City of Portsmouth, Virginia desire more aggressive enforcement <br />action against nuisances. A citizens group, working with city staff, has reviewed and <br />recommended changes that will allow for more efficient and effective enforcement <br />actions against nuisances and improve the quality of the city's neighborhoods. <br /> <br />· The proposed revisions address legislative changes dealing with reasonable notice <br />and the creation of regulations to address drug blight. Proposed revisions also address <br />administrative changes that have occurred over time. <br /> <br />· Recommended changes also provide for more efficient movement of vehicles in the <br />City compound. <br /> <br />· The citizens and staff desire a method of requiring the owner of nuisance property to <br />permanently correct the conditions or be held accountable for the total costs of <br />abatement. <br /> <br />· The General Assembly of Virginia has enacted legislation that provides additional <br />local authority to enforce nuisance regulations that will enhance the livability of the <br />various neighborhoods within the City. <br /> <br /> <br />
