<br /> WHEREAS, this Council is aware of the federal regulations governing the undertaking
<br />and carrying out of activities under the Housing and Community Development Program; and
<br />
<br /> WHEREAS, this Council, on behalf of the City of Portsmouth, possesses the legal authorit~
<br />to apply for a grant and execute the prcposed Program under the provisions of the aforemen~
<br />tioned Act; and
<br />
<br /> WHEREAS, this Council recognizes its responsibility to direct that safeguards be estab-
<br />lished to protect employees from using their position for a purpose that gives the appearance
<br />of being motivated by a desmre for private gain £or themselves or others, particularly those
<br />with whom they have family, business or other ties; and
<br />
<br /> WHEREAS, this Council has found said 1982 Housing and Community Development Program
<br />and the Proposed Statement of Objectives and Use of Funds are appropriate to meet the needs
<br />of the City and, therefore, acceptable.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, ¥irginia,
<br />that the 1982 Housing and Community Development Program and the Proposed Statement of
<br />Objectives and Use of Funds, having been reviewed and considered, be and hereby are approved
<br />in all ~espects and th~ City-.:.Managerris,cher~by A~tho~i'ze~'to file the Statement of Objective~
<br />and Use of Funds and any additional information as may be required with the Department of
<br />Housing and Urban Development in order to obtain the 1982 Block Grant; and
<br />
<br /> BE IT FURTHER RESOLVED that the City Manager is designated as the certifying officer
<br />and authorized representative of the City of Portsmouth and shall provide assurances as
<br />required by the regulations of the Housing and Community Development Act of 1974 as amended,
<br />for the approval of the 1982 Community Development Program." '

<br />conveyance of 2 acres of land, more or less, located at the
<br />and Cedar Lane.

<br /> The City sought to acquire a 15' strip of property along Cedar Lane for street improve-
<br />men~s from Mr. J. J. Garner. Mr. Garner has offered to deed to the City said 15' strip as
<br />well as the remaining 1.9 acres located at the intersection of High Street West and Cedar
<br />Lane. Fhe proposed resolution accepts this property as a gift The City Manager recommends
<br />adoption." '

<br /> On motion of Mr. Barnes and seconded by Mrs. Webb, the following resolutior was adopted,
<br />and by the following vote:
<br />
<br />"A RESOLUTION ACCEPTING AS A GIFT FROM JOSEPH J. GARNER, JR. THE CONVEYANCE OF
<br />2 ACRES OF LAND, MORE OR LESS, LOCATED AT THE INTERSECTION OF HIGH STREET WEST
<br />AND CEDAR LANE.
<br />
<br /> WHEREAS, Joseph J. Garner, Jr. owns a certain parcel of undeveloped land located in
<br />the City, of Portsmouth, Virginia, which he wishes to donate, give and convey to the City
<br />of Portsmouth; and
<br />
<br /> WHEREAS, at the request of the City of Portsmouth said property was recently appraised
<br />at the value of Fifty Thousand ($50,000) Dollars, which is believed to represent the present
<br />fair market value of said property; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth has detsrmined that acquisiti3n of
<br />said property will be beneficial to the City of Portsmouth and its citizens.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />~he City o~'Portsmouth shall, and does hereby accept as a gift from Joseph J. Garner, Jr.,
<br />for the benefit of the City of Portsmouth and its citizens, that certain parcel of land
<br />located in the City of Portsmouth, Virginia, on the northwest intersection of High Street
<br />West and Cedar Lane, containing 2 acres, more or less, more particularly described in a
<br />certain deed of gift from Joseph J. Garner, Jr., dated October 12, 1981.
<br />
<br /> BE IT FURTHER RESOLVED that the Council of the City Of Portsmouth, Virginia, hereby
<br />expresses iti'gratitude to Joseph J. Garner, Jr. for this generous and beneficial conveyance
<br />to the City."

<br /> The Mayor requested that a letter of thanks be forwarded to Mr Garner for the generous
<br />gift. ·
<br />
<br /> Motion of Mr. Oast and secon~ad by Mrs. Webb, recommendations for use of the property to
<br />be referred to the City Manager for investigation and a report be furnishe~, was adopted by
<br />unanimous vote.
