<br /> 4.- To require the owners or tenants of any property in the district to connect with any
<br />such system or systems, and to contract with the owners or tenants for such connections. The
<br />owners or tenants shall have the right of appeal to the Circuit Court of the City of Portsmout
<br />orzth~jBd~e~thereof in vacation, in regards to connection to such services within ten (10)
<br />days from notice by the City to so connect.
<br />
<br /> 5. To levy and collect an annual tax upon any property in such service district subject
<br />to local taxation to pay, either in whole or in part, the expenses and charges for providing
<br />such additional governmental services or facilities in such district and for constructing,
<br />maintaining and operating such facilities and equipment as may be necessary and desirable in
<br />connection therewith, provided that the proceeds from such annual tax shall be so segregated
<br />as to enable the same to be expended in the district from which collected.

<br /> 6. To authorize the City Manager to employ and fix the compensation of any technical,
<br />clerical, or other persdnnel which may be necessary or desirable from time to time to provide
<br />such additional governmental services in such district or for the construction, operation or
<br />mainteaance of any such facilities and equipment as may be necessary or desirable in connectic
<br />therewith.

<br /> To negotiate and contract with any person, firm, corporation or political subdivisio~
<br />with regard to the connection of any such equipment or systems with any other equipment, facil
<br />ties or public systems now ~n peratlon or hereinafter established, and with regard to any
<br />other matter necessary and proper for the construction or operation and maintenance of any suc
<br />system within the district.

<br />2. By amending Article II, Section 2.09 to read as follows:
<br />
<br />Section 2.09. Sale of City rights in water front, streets, utilities, works, etc.
<br />
<br /> (a) The rights of the City of Portsmouth in and to its water front, wharf property,
<br />public landings, wharves, docks, streets, avenues, parks, bridges and other public places, and
<br />· ts gas, water and electric works, shall not be sold, except by a resolution passed by a re-
<br />corded affirmative vote of two-thirds (2/3) of all the members elected to the Council.
<br />
<br /> (b) No franchise, lease, or right of any kind to use any such public property or any
<br />other public property or easement of any descFiption in a manner not permitted to the general
<br />public shall be granted for a longer period than forty (40) years, except for air rights toget
<br />wiihzeaaemmn~s.'for columns of support, which may be granted for a period not exceeding sixty
<br />(60) years.
<br />
<br /> Before selling any such prcperty, and before granting any franchise, privilege, lease,
<br />or right of any kind to use any public property or easement of any description, for a term
<br />in excess of five (5) years, except in the cake of and for a trunk railway, the City shall
<br />first, after due advertisement, receive bids zherefor publicly. Such advertisement shall be
<br />published for at least three (3) days in a newspaper published in, or having a general circula
<br />tion in, the City of Portsmouth. Such bids may be upon such terms and may be received in such
<br />manner as the City Manager may determine, unless the Council shall direct otherwise.

<br /> Such grantt, and any contract in pursuans~

<br />Commission to amend the transit service program for Portsmouth.
<br />
<br /> The Tidewater Transportation Commission recently held a public hearing in Portsmouth at
<br />Council's request concerning several proposed transit service changes which were recommended
<br />by TTDC in..order to keep the City's transit e~penditures in balance with the budget. The
<br />
