<br />amend the Charter of the City of Portsmouth, Virginia.

<br /> This resolution requests the members of the General Assembly representing the City to
<br />introduce a bill in the next session of the General Assembly amending the City Charter. The
<br />public hearing on the proposed changes was held on this date to determine if such changes are
<br />necessary and desirable. The City Manager recommends adoption."

<br /> On motion of Mr. Barnes and seconded by Mrs. Webb, the following resolution was adopted,
<br />and by the following vote:
<br />
<br />'A RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA TO AMEND THE CHARTER
<br />OF THE CITY OF PORTSMOUTH, VIRGINIA.
<br />
<br /> WHEREAS, Section 15.1-835 of the Code of Virginia, 1950, as amended, provides for the
<br />amendment of the City Charter upon the holding of a public hearing to determine if the citi-
<br />zens of the City desire that the amendment to the City Charter be granted and by forwarding
<br />thereafter a request to one (1) or more members of the General Assembly representing the City
<br />to introduce the proposed change as a bill in the succeeding session of the General Assmebly;
<br />and
<br />
<br /> WHEREAS, the City Council is of the opinion that certain amendments to the Charter of
<br />the City of Portsmouth is necessary and desirable at this time and has, on this date, held
<br />such public hearing required by law to consider such amendments.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmoutb, Virginia,
<br />that the City Attorney is hereby directed to prepare and transmit to the members of the
<br />General Assembly representing the City, together with certified copies of this Resolution,
<br />a draft of a bill amending the Charter of the City of Portsmouth, 1970, as follows:
<br />
<br />1. By amending Article II by adding thereto Section 2.O2:1 to read as follows:
<br />
<br />Section 2.02:1. Special Service District.
<br />
<br /> A special servic~ district of the downtown business district of the City of Portsmouth
<br />shall be created by the governing body of the City of Portsmouth, upon petition of fifty (50%
<br />percent of the property owners of the proposed district. Upon the filing of such petition, th
<br />governing body shall fix a date for a public hearing on the question of the proposed service
<br />district, which hearing shall embrace a consideration of whether the property within the pro-
<br />posed district will be benefited by the establishment thereof. Notice of such hearing shall
<br />be given by publication once a week for three consecutive weeks in a new~paper of general
<br />circulation in the City of Portsmouth, and the hearing shall not be held sooner than ten (10)
<br />days after completion of such publication.
<br />
<br /> After creating the special service district, the City Council shall have the following
<br />powers and duties with respect to the service district:
<br />
<br /> 1. To construct, maintain and operate such facilities and equipment as may be necessary
<br />or desirable to provide additional governmental services and~'or facilities, including but not
<br />limited to, water supply, sewerage, garbage removal and disposal, heat, light, public trans-
<br />portation service, fire fighting equipment and fire protection, power and gas systems, police
<br />protection, parking facilities, promotion of the business district, and sidewalks and/or pedes
<br />trian malls for the use and benefit of the public in such service district.
<br />
<br /> 2. To acquire by gift, condemnation, purchase, lease or otherwise and to maintain and
<br />operate any such facilities and equipment as may be necessary and desirable to provide such
<br />additional governmental services zn such district, and to acquire by gift, condemnation,
<br />purchase, lease or otherwise, rights, title, interest or easements therefor in and to real
<br />estate in such service district.
<br />
<br /> 3. Fo contract with any person, firm, corporation or political subdivision to provide
<br />such additional governmental services or facilities in such district and to construct, esta-
<br />blish, maintain and operate any such facilities and equipment as may be necessary and desir-
<br />able in connection therewith.
