February 23, 1982 <br /> <br /> (f) That the applicant will install a four (4) foot sidewalk along the north <br />property line beginning a~ the existing sidewalk on the east property line and going back <br />the alley on the west property line as shown on the attached site plan. <br /> <br /> (g) That the applicant will provide three (3) parking spaces in back of the <br />building off of the existing alley way as shown on the attached site plan. <br /> <br /> (h) That the applicant will patch three (3) areas of broken curbing along the <br />north side of the property as shown on the attached site plan." <br /> <br />to <br /> <br />(i) <br /> <br />"A~RESOLUTION GRANTING A USE PERMIT TO THE PRENTIS PARK/MIDTOWN CONGREGATIONS <br /> OF JEHOVAH'S WITNESSES TO OPERATE A HOUSE OF WORSHIP ON LAND LOCATED ON THE <br /> SOUTH SIDE OF ELLIOTT STREET WEST OF ITg INTERSECTION WITH QUANTICO STREET. <br /> <br /> WHEREAS, the Prentis Park/Midtown Congregations of Jehovah's Witnesses made an applicat <br />pursuant to S40-71(b) of the Code of the City of Portsmouth, 1973, as amended, for the grant- <br />ing of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighbor-hood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br />granted a <br />operate a <br /> <br />That the Prentis Park/Midtown Congregations of Jehovah's Witnesses is hereby <br />use permit pursuant to ~40-71(b) of the Code of the City of Portsmouth, 1973, <br />house of worship at the property described as follows: <br /> <br />tO <br /> <br />UP-82-7 <br /> <br /> Beginning on the south side of Elliott Street 100 feet, more or less west from its <br />intersection with Quantico Street; thence southeast 267.24 feet; thence southwesterly <br />200 feet; thence northwesterly 400 feet To the south right-of-way of Elliott Street; <br />thence northeasterly along said right-of-way 250 feet, more or less, to the point <br />of origin. <br /> <br />This use permit is approved subject to the following conditions: <br /> <br /> (a) That the applicant will comply with all the Commercial C-2 Zoning District <br />requirements relating to the construction and occupancy of a house of worship. <br /> <br /> (b) That this use permit would be considered revoked unless building permits are <br />issued and construction of the proposed church is under way within one (1) year from the <br />date of the approval of this use permit. <br /> <br /> (c) That the use permit is issued to the Prentis Park/Midtown Congregations of <br />Jehovah's Witnesses and is not transferrable to any other person or entity." <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br />82-50 Items Removed from the Consent Agenda were presented: <br /> <br />(a) Zoning Amendment Ordinance Z 81-14 <br /> <br />Petition of the City Planning Commission, by <br />Planning Director James M. Bray, approved on first <br />reading at the Public Hearing of February 8, 1982. <br /> <br /> Motion of Mr. Whitlow- and seconded by Mr. Barnes, that Z 81-14 be adopted on final <br />reading. <br /> <br /> Substitute motion of Mr. Oast and seconded by Mrs. Webb, that the original proposal by thc <br />Planning Commission, Parcels 3 ~ ~ be zoned R~100 be adopted. <br /> <br /> Motion of Mr. Oast and seconded by Mr. Gray, to suspend the rules for Gordon B. Tayloe, <br />Jr., representing Homer Armistead Estate, the developer, was adopted by unanimous~vote. <br /> <br /> Gordon B. Tayloe, Jr., Attorney, Central Fidelity Bank Buildiny, spoke on behalf of the <br />developer, and stated that a letter of intent concerning the recreational uses would be sub- <br />mitted. (See letter attached to Ordinance 1982-13) <br /> <br />Substitute motion was defeated by the following vote: <br /> <br />Ayes: Oast, Webb <br />Nays: Barnes, Beamer, Gray, Whitlow, Johansen <br /> <br /> <br />
