<br />At a regular meeting of the City Council held on February 23, 1982, there were present:

<br />Steven Lieberman, City Attorney.
<br />

<br /> Rev. Lee V. Ruckman, Jr., Pastor, West End United Methodist Church, opened the meeting
<br />with prayer, followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Johansen welcomed all visitors in attendance.
<br />
<br /> Motion of Mr. Beamer and seconded by Mrs. Webb, minutes of the called meeting of Februar~

<br />meeting of February 16, 1982, to be approved as received, and was adopted by unanimous vote.

<br />Councilwoman Webb requested that Items (a) and (g) be removed from the Consent Agenda.

<br /> CHILD DAY CARE CENTER AT 600 BROAD STREET.
<br />
<br /> WHEREAS, Jesse A. DeBraux, Sr. made
<br />of the City of Portsmouth, Virginia, 1973,
<br />described; and
<br />
<br />an application pursuant to S40-79[b)~sf the Code
<br />for the granting of a use permit a.s ~ereina~er-
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be
<br />done in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit hereinafter is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will no~ be detrimental to the public use or mn~urious to the property or
<br />improvements in the neighborhood; and
<br />
<br />(C) Will be in accord with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> 2. That Jesse A. DeBraux, Sr. is hereby granted a use permit pursuant to ~40-79(b) of
<br />{he Code of the City of Portsmouth to operate a Child Day Care Center at the property describ-
<br />ed as follows:
<br />

<br /> Beginning at the southwest corner of Broad Street and Woodrow Street; thence
<br />south along Broad Street 120'; thence west 140' to an alley; thence north along
<br />said alley 120' to the south right-of-way of Woodrow Street; thence east along
<br />said right-of-way 140' to Broad Street, the point of origin.
<br />
<br />3. This use permit is approved subject to the following conditions:
<br />
<br /> (a) That the Child Day Care Center may be operated for up to twenty-five (25)
<br />children to be cared for in the facility at any one time and is limited to serve children
<br />between two and one-half (2-1/2) to six (6) years of age only.
<br />
<br /> (b) That interior operations of the facility will be conducted only between the
<br />hours of 6:00 A. M. to 6:00 P. M.. The exterior playyard facilities will only be used between
<br />the hours of 8:00 A. M. to 6:00 P. M,.
<br />
<br /> (c) That the play area will not be less than sixty-five by sixty (65' x 60') feet
<br />and will be surrounded by a masonry or solid wood fence at least five (5) feet in height.
<br />
<br /> (d) That the applicant shall comply with all codes, ordinances, policies and
<br />regulations of federal, state and local governments that may be applicable and shall have
<br />obtained all necessary licenses and permits required for this use.
<br />
<br /> (e) Th&t the use permit is issued to Jesse A. DeBraux, Sr. and is not transferrable
<br />to any other person or entity.
