58 <br /> <br />April 13~ 1982 <br /> <br /> 82-129 "Consideration of a resolntion authorizing the construction and installation <br />of sidewalks along Langley Court, and assessing the abutting landowners at the rate of $3.00 <br />per lineal foot. <br /> <br /> A petition has been filed by all six property owners on Langley Court requesting the <br />City to install sidewalks along this street. The assessment of the cost of this sidewalk <br />installation ~or each property owner per lineal foot of frontage on the street in question <br />has keen made by the Public Works Department. Notice has been submitted to the property owne <br />by the City Clerk that this matter will be considered by City Ccuncil at the Council meeting <br />on April 13, 1982. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Whitlow and seconded by Mrs. Webb, the following resolution was adopted <br />and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CONSTRUCTION AND INSTALLATION OF SIDEWALKS <br /> ALONG LANGLEY COURT ABUTTING 1, 3~ 5, 9 AND 11 LANGLEY COURT WHERE STANDARD <br /> SIDEWALKS DO NOT NOW EXIST, ASSESSING T~E ABUTTING LANDOWNERS A~ THE RATE OF <br /> $3.00 PER LINEAL FOOT, AND DIRECTING THAT AN ABSTRACT OF THIS RESOLUTION BE <br /> RECORDED TOGETHER WITH THE STATEMENT SHOWING THE ESTIMATED AMOUNT THAT WILL BE <br /> ASSESSED AGAINST ~ACH S~CH LANDOWNER. <br /> <br /> WHEREAS, by petition submitted in accordance with law, certain abutting landowners have <br />petitioned ~he City of Portsmouth to construct a sidewalk along Langley Conrt abutting l, 3, <br />5, 7, 9 and 11 Langley Court where standard sidewalks do not no~ exist, the cost thereof to <br />be apportioned between the City and the abutting landlowners as provided by law; and <br /> <br /> WHEREAS, notice has been duly given to the abutting landowners, as provided by law, that <br /> a hearing would be held before the Council of the City of Portsmouth on April 13, 1982, at <br /> 7:30 P. M. in the Council Chambers; and <br /> <br /> WHEREAS, said hearing was duly held and in the judgmen~ of this Council the said sidewal~ <br />should be constructed. <br /> <br />NOW, THgREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the construction of a sidewalk along Langley Ccurt abutting 1, 3, 5, 7, 9 <br />and 11 Langley Court where standard sidewalks do not now exist, is hereby authorized. <br /> <br /> 2. That the abutting landowners shall be assessed at <br />lineal~£oot pursuant to a petition signed by seventy five <br />affected by the requested improvements. <br /> <br />the rate of three dollars ($3.00) <br />percent (75%) of the property owner~ <br /> <br /> 3. That the City Clerk shall forthwith cause to be recorded an abstract of this Resolu- <br />tion, together with statements showing the ownership and location of the property to be affect <br />by the proposed'~sidewalk construction and the estimated amount that will be assessed against <br />each abutting landowner in accordance with the statement thereof on file in her office." <br /> <br />Ayes: Beamer, Gray, Oast, Webb, Whitlow <br />Nays: None <br /> <br /> 82-130 "Consideration of a resolution authorizing the City Manager to convey Cit~owned <br />property (813 and 817 Washington Street) to Portsmouth Redevelopment and Housing Authority. <br /> <br /> The City of Portsmouth purchased the property known as 813 and 817 Washington Street in <br />1979. The cost of acquisition of this property by the City was $3,530. This property is <br />located in the Downtown South Redevelopment Project Area. PRHA has requested transfer of <br />this property in order to develop dispositon parcels in the Project area. PRHA has agreed to <br />pay the cost which the City incurred in acquiring this property in the amount of $3,530. The <br />City Manager recommends adoption." <br /> <br /> On motion of Mr. Whitlow and seconded by Mrs. Webb, the following resolution was adopted <br />and by the~ following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY CITY OWNED PROPERTY <br /> (813 AND 817 WASHINGTON STREET) TO PORTSMOUTH REDEVELOPMENT AND HOUSING <br /> AUTHORITY. <br /> <br /> WHEREAS, the City of Portsmouth owns certain real property <br />ington Street; and <br /> <br /> WHEREAS, the Portsmouth Redevelopment and Housing Authority <br />property to be consolidated with other properties as disposition <br />the Downtown South Redevelopment Project; and <br /> <br />located at 813 and 817 Wash- <br /> <br /> desires to purchase said <br /> parcels in connection with <br /> <br /> WHEREAS, the City of Portsmouth has no further requirements for use of said proper~y <br />and it is, hereby, declared to be excess property; and <br /> <br /> WHEREAS, pursuant to ~2.O9(c) of the Charter of the City of Portsmouth real property may <br />be conveyed to the Commonwealth of Virginia or a political subdivision thereof without adver- <br />tisement and receipt of bids; and <br /> <br /> WHEREAS, the Portsmouth Redevelopment and Housing Authority is a political subdivision <br />of the Commonwealth of Virginia; and <br /> <br /> <br />
