58 April 13~ 1982 82-129 "Consideration of a resolntion authorizing the construction and installation of sidewalks along Langley Court, and assessing the abutting landowners at the rate of $3.00 per lineal foot. A petition has been filed by all six property owners on Langley Court requesting the City to install sidewalks along this street. The assessment of the cost of this sidewalk installation ~or each property owner per lineal foot of frontage on the street in question has keen made by the Public Works Department. Notice has been submitted to the property owne by the City Clerk that this matter will be considered by City Ccuncil at the Council meeting on April 13, 1982. The City Manager recommends adoption." On motion of Mr. Whitlow and seconded by Mrs. Webb, the following resolution was adopted and by the following vote: "A RESOLUTION AUTHORIZING THE CONSTRUCTION AND INSTALLATION OF SIDEWALKS ALONG LANGLEY COURT ABUTTING 1, 3~ 5, 9 AND 11 LANGLEY COURT WHERE STANDARD SIDEWALKS DO NOT NOW EXIST, ASSESSING T~E ABUTTING LANDOWNERS A~ THE RATE OF $3.00 PER LINEAL FOOT, AND DIRECTING THAT AN ABSTRACT OF THIS RESOLUTION BE RECORDED TOGETHER WITH THE STATEMENT SHOWING THE ESTIMATED AMOUNT THAT WILL BE ASSESSED AGAINST ~ACH S~CH LANDOWNER. WHEREAS, by petition submitted in accordance with law, certain abutting landowners have petitioned ~he City of Portsmouth to construct a sidewalk along Langley Conrt abutting l, 3, 5, 7, 9 and 11 Langley Court where standard sidewalks do not no~ exist, the cost thereof to be apportioned between the City and the abutting landlowners as provided by law; and WHEREAS, notice has been duly given to the abutting landowners, as provided by law, that a hearing would be held before the Council of the City of Portsmouth on April 13, 1982, at 7:30 P. M. in the Council Chambers; and WHEREAS, said hearing was duly held and in the judgmen~ of this Council the said sidewal~ should be constructed. NOW, THgREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the construction of a sidewalk along Langley Ccurt abutting 1, 3, 5, 7, 9 and 11 Langley Court where standard sidewalks do not now exist, is hereby authorized. 2. That the abutting landowners shall be assessed at lineal~£oot pursuant to a petition signed by seventy five affected by the requested improvements. the rate of three dollars ($3.00) percent (75%) of the property owner~ 3. That the City Clerk shall forthwith cause to be recorded an abstract of this Resolu- tion, together with statements showing the ownership and location of the property to be affect by the proposed'~sidewalk construction and the estimated amount that will be assessed against each abutting landowner in accordance with the statement thereof on file in her office." Ayes: Beamer, Gray, Oast, Webb, Whitlow Nays: None 82-130 "Consideration of a resolution authorizing the City Manager to convey Cit~owned property (813 and 817 Washington Street) to Portsmouth Redevelopment and Housing Authority. The City of Portsmouth purchased the property known as 813 and 817 Washington Street in 1979. The cost of acquisition of this property by the City was $3,530. This property is located in the Downtown South Redevelopment Project Area. PRHA has requested transfer of this property in order to develop dispositon parcels in the Project area. PRHA has agreed to pay the cost which the City incurred in acquiring this property in the amount of $3,530. The City Manager recommends adoption." On motion of Mr. Whitlow and seconded by Mrs. Webb, the following resolution was adopted and by the~ following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY CITY OWNED PROPERTY (813 AND 817 WASHINGTON STREET) TO PORTSMOUTH REDEVELOPMENT AND HOUSING AUTHORITY. WHEREAS, the City of Portsmouth owns certain real property ington Street; and WHEREAS, the Portsmouth Redevelopment and Housing Authority property to be consolidated with other properties as disposition the Downtown South Redevelopment Project; and located at 813 and 817 Wash- desires to purchase said parcels in connection with WHEREAS, the City of Portsmouth has no further requirements for use of said proper~y and it is, hereby, declared to be excess property; and WHEREAS, pursuant to ~2.O9(c) of the Charter of the City of Portsmouth real property may be conveyed to the Commonwealth of Virginia or a political subdivision thereof without adver- tisement and receipt of bids; and WHEREAS, the Portsmouth Redevelopment and Housing Authority is a political subdivision of the Commonwealth of Virginia; and
