April 13, 1982 <br /> <br /> 82-12~ "Consideration of an ordinance to amend Sections 32-60.4 and 32-60 - of the City <br />Code pertaining to erosion and sediment control. ' <br /> <br /> The State Handbook of the Virginia Soil g Water Conservation Commission has been revised <br />and updated to provide for more stringent guidelines in connection with erosion and sediment <br />control plans for development of real property. In order to bring the local erosion and sedi- <br />ment control regulations into compliance with the revised State Standards, it will be necessar <br />to amend Sections 32-60.4 and 32-60.- of the City Code. The proposed amendments have been <br />reviewed by the Virginia Soil g Water Conservation Commission and have been found to be in <br />compliance with the State Standards. The City Manager recommends adoption." <br /> <br /> On motion of ~. Gray and seconded by Mr. Oast, the following ordinance was adopted on <br />first and final reading, and by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND SECTIONS 32-60.4 AND 32-60.7 OF THE CODE OF THE CITY <br /> OF PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO EROSION AND SEDIMENT CONTROL." <br /> <br /> Ayes: Beamer, Gray, Oast, Webb, Whitlow <br /> Nays: None <br /> <br />82-127 "Consideration of an ordinance closing a portion of Arizona Street. <br /> <br /> Ellen C. Davis has petitioned for the closing of a portion of Arizona Street. Viewers <br />were appoigted on March 23, 1982, pursuant to State law and a copy of their report and a map <br />showing the portion to be closed is attached for your information. The Planning Commission <br />has recommended denial of this street closure due to the fact that the property owner had <br />not obtained construction and landfill permits from the Corps of Engineers. The City Manager <br />recommends denial of this petition." <br /> <br /> Jim Backus, 324 London Boulevard, representing Ellen Davis, requested closing of the <br />portion of Arizona Avenue as petitioned. <br /> <br /> Motion of Mrs. Webb and secondeJ by Mr. Whitlow, to consur in the recommendation of the <br />City Manager, the ordinance was denied, and by the following vote: <br /> <br />Ayes: Beamer, Oast, Webb <br />Nays: Gray, Whitlow <br /> <br /> 82-128 - "Consideration of a resoIution authorizing the City Manager to sell certain <br />office furniture and equipment to the City of Suffolk. <br /> <br /> the City of Suffolk has offered to purchase the office furniture and equipment located in <br />the City Hall in Suffolk which was previously used for the Public Utility Office for billing <br />and collection of water accounts for Suffolk residents. After July 1, 1982, this office <br />will no longer be maintained by the City of Portsmouth. The furniture and equipment have been <br />appraised by Buck Office Supply Company at a value of $1,475. The Public Utility Department <br />has indicated that it has no need for this equipment after July 1, 1982. The City Manager <br />recommends adoption." <br /> <br /> On motion of Mr. Oast and seconded by Mrs. Webb, the following resolution was adopted, <br />and by t~e following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO SELL CERTAIN OFFICE FURNITURE <br />AND EQUIPMENT TO THE CITY OF SUFFOLK FOR THE SUM OF $1,475. <br /> <br /> WHEREAS, pursuant to a contract between the City of Portsmouth and the City of Suffolk <br />effective July 1, 1982, the City of Portsmouth will no longer operate and maintain an office a <br />the City Hall of the City of Suffolk for the purpose of collecting and administering public <br />utility accounts for residents of the City of Suffolk; and <br /> <br /> WHEREKS, the City of Suffolk has made an offer to purchase the office furniture and equip <br />ment owned by the City of Portsmouth and presently located in said office in the City Hall of <br />the-~City'.'of~Suffolk; and <br /> <br /> WHEREAS, said equipment has been independently appraised at a value of One Thousand, Four <br />Hundred Seventy-Five Dollars ~$1,475.); and <br /> <br /> WHEREAS, said furniture and equipment is no longer required by the City of Portsmouth <br />for its purposes and use and hereby zs deemed to be excess furniture and equipment; and <br /> <br /> WHEREAS, Section 2.09(c) of the Charter of the City of Portsmouth, Virginia, 1973, as <br />amended, provides that the City may sell any of its property to the Commonwealth of Virginia <br />or any political subdivision thereof without advertisement and without receiving bids; and <br /> <br /> WHEREAS, the City of Suffolk is a political subdivision of the Commonwealth of Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and here hereby is, authorized to sell certain office furniture and <br />equipment as hereinafter designated to the City of Suffolk for the sum of One Thousand, <br />Four Hundred Seventy-Five Dollars ($1,~75.)." <br /> <br />Ayes: Beamer, Gray, Oast, ~ebb, Whitlow <br />Nays: None <br /> <br /> <br />
